Please call us or text us at Silver Lake 903-875-9458 prior to auction day if you are entering an absentee / online bid and have a question about an item. Buyers are encouraged to closely physically inspect items prior to the auction. By placing a bid, bidder signifies that they have examined the items to their satisfaction, or that they have chosen not to personally examine them. A bid is a binding contract. Non paying bidders will be reported to Hibid. There will be a 13 per cent buyers premium added to the total of items purchased for this auction with a 3 per cent discount for cash payment. This is to help cover the cost of auction workers and incidental expenses. There will be Texas Sales Tax of 7.75% unless the buyer has a valid resale tax certificate on file with us or the item being sold is not subject to sales tax, such as U.S. coins and currency. Methods of payment include cash, check, or credit card with valid ID. There is a $35 charge for returned checks. We do not used Hibid's checkout system therefore once you receive your invoice you will need to call us with your card info or come by the auction house to pay. Winning bidders will be sent an email the day following the auction if they win items. GENERAL PICKUP will be open at 121 N Garitty, Frost, Texas without appointment the day following the auction from 9am to 5pm. For the following 2 days, pickup will be by appointment by calling 903-875-9458. All items won must be paid for and picked up within 1 week of the auction close. Bidders who do not follow through with payment by the deadline will have their bids cancelled and the items may be sold to the backup bidder or returned to consignor. Paid items must be removed from the auction premises within 1 week of the auction close. Any items left at the auction past this day, whether paid for or not, are thereby abandoned and may be resold or moved to storage. Storage units may be rented near the auction site if needed, subject to availability. Buyers are responsible for packing and loading items and encouraged to bring their own packing materials and loading help although we usually have an auction worker available to help during general pickup time. Once you are declared the winner of an item you are responsible for loss or damage. By placing a bid through this website or at the live auction, you are entering into a legally binding contract and agree to follow through with the payment for and pickup of the item as specified above. Bidder expressly agrees not to stop payment, dispute or contest auction transactions and agrees to payment rules and item abandonment rules above stated. If the auction is being done as a live auction, all announcements made at the live auction supercede all previous announcements online or offline. Live floor bids have priority over absentee bidders in the case of a TIE BID. For example if an item starts at $5.00, you bid $7.50 absentee, and no other absentee bids are left. The auctioneer will ask for $7.50 to open. If there is a floor bid for $7.50, the absentee bidder (you) will not win the item. If no one at the live auction enters a bid, you will win the item for $5.00. All sales are final with no returns. Anyone who is age 18 or over may bid, however Silver Lake Auction LLC reserves the right to reject a bid from any bidder. Bidders who have negative hibid ratings or who have failed to pay or pickup items previously may have their bids cancelled or denied. Workers at the auction as well as the auctioneer himself may bid. The highest bidder acknowledged by the auctioneer shall be the purchaser. For live auctions, in the event of a dispute between bidders, or if the auctioneer doubts the validity of a bid, the auctioneer shall have sole discretion to name the successful bidder, reopen the bidding between two tie bidders, or resell the item. Bidders are responsible for their own merchandise once they are recognized as the purchaser. The auctioneer may at his discretion combine or divide lots during a live auction. Anyone entering the auction premises for any reason does so at their own risk. Neither Silver Lake Auction LLC nor Garitty Pace LLC (owner of the premises) are responsible for accidents, nor is the auctioneer. If you are unable to attend a live auction or are not comfortable using a computer or phone to bid, you may leave an absentee bid by calling us up to 24 hours before the auction begins to close. Shipping may typically be arranged on smaller items by Silver Lake Auction LLC at actual postage rates. No fees or other charges will occur unless shipping the item requires more than 30 minutes of our time. Silver Lake Auction LLC makes no warranty with respect to shipping items. Silver Lake Auction LLC and its consignors reserve the right to remove any and all items from a sale at any time, up until the time the item is sold, and auction may be canceled or postponed in the event of inclement weather, power outages, or other unforeseen events.
