Listing Terms and Conditions
The property will be offered in 2 tracts & in combination through our multi-parcel bidding system. The farm is being sold subject to a cropland lease for 2021 with the Seller's retaining all 2021 cropland lease payments. The Buyer or Buyers shall enter into a purchase agreements and make a 20% Non-Refundable down-payments the day of the auction. The closing shall be held on or before January 30, 2022 with the remaining balance due & payable in full. The sale will NOT be contingent upon any buyer financing. The buyer is responsible for all real estate taxes that are due and payable in 2022 and thereafter. Property is being sold "AS IS", Property is being sold subject to any easements including road, drainage, utility or other easements of record or pending, including a snowmobile trail that crosses Parcel #2. Buyer agrees to keep property in compliance with the present CRP contract and assumes all liability for said contract on Parcel #2. The buyer of Parcel #2 will be assigned the CRP payments for 2020 & 2021 and thereafter. The buyer agrees to purchase the property subject to easements of records and takes the property subject to a surface/subsurface water drainage system comprised of (5) open drain ditches/culverts/subsurface drainage on the west side of the parcel that aren't of record. Seller is aware of small area of CRP land that was damaged by water runoff on Parcel #2. Buyer shall be responsible any and all repairs required by the FSA in connection to the current CRP contract regarding the damage due to water run-off. Prospective buyers are encouraged to inspect the property prior to the auction. The sellers do not warranty or guarantee that existing fences lie on the true boundary and any new fencing, if any, will be the responsibility of the purchaser pursuant to MN statues. The buyers are responsible for all inspections of the property prior to their purchase of it. The sale is subject to the seller's approval.
