Harmeyer Auction & Appraisal Co., LLC. retains the right to govern goods and services sold to clients and to maintain the level and integrity of our business. Harmeyer Auction & Appraisal Co., LLC. has the right to terminate the auction at any time; withdrawal from sale of any item; to sell at this auction items not listed; to group one of more lots into one or more selling lots or to subdivide into two lots or more selling lots. The auction company also reserves the right to sell all of the items listed in bulk.
Payment:
a) All payments will be required to be paid for with the credit card on file after auction is complete.
b) Buyer's Premium is 13% Online
c) Buyer specifically waves the right to dispute or deny payment for any purchases made with a credit card.
d) No items will be removed until they have been paid for. Purchaser is responsible for removal of all purchased goods. No abandonment of purchased items is allowed. All abandoned items will be sold for storage and moving fees.
Loading Equipment:
a) Buyer is responsible for their own removal of all items. Please bring any packing material and boxes that you may need. Please bring assistance to move heavy items to your vehicle and any tools for dismantling.
Pick up of Items:
a) All items must be on the scheduled pick up date.
b) Outside of the Base Road Location-All Items must be picked up on the scheduled pick up times. If they are not they will be considered abandoned and become the possession of Harmeyer Auction, No Refund will be issued (10/7/2020)
c) Base Road Location: Any item remaining in our building 7 days after the scheduled auction pick up will be considered abandoned and become the possession of Harmeyer Auction, No Refund will be issued (10/7/2020)
No Liability:
a) Harmeyer Auction & Appraisal Co., LLC. assumes no liability for your purchases. The buyer assumes and does agree to indemnify and hold the auction company and seller harmless from any future claim that shall pertain to fitness or use of the asset being purchased.
b) Persons attending during exhibition, sale or removal of goods assume all risks of damage or loss to person and property and specifically release and indemnify the Auction Company from liability therefore. Neither the Auction Company nor his principal or seller shall be liable by reason of any defect in or condition of the premises in which the sale is held. Consignors & Bidders: a) All consignors must fill out a contract with Harmeyer Auction & Appraisal Co., LLC., sign forms and abide by our terms listed.
b) All bidders must register for bidder's numbers using proper ID or proper information.
c) Any employee of Harmeyer Auction & Appraisal Co., LLC. may bid at any auction if they wish to purchase an item.
d) All items become the sole responsibility of the purchaser when the auctioneer confirms your bid as the successful winner. We are not responsible for lost or stolen items.
e) If there is any dispute between two or more bidders, the auction company or its' auctioneer, may decide the successful bidder. The decision of the auction company, or its' auctioneer, shall be final and absolute.
Loss of Bidding Privileges:
a) If you have failed to pay for an item your bidding privileges will be revoked. Your privileges may be restored by paying for the item or repaying for the loss of the revenue due to the items not having been sold and by placing a credit card on permanent file whereby future purchases will automatically be charged.
Delinquent Accounts:
a) The bidder that has not paid for, or has not removed their items from the auction site, will be subject to the cost of storage, trucking, re-sale, deficiency balances, collection fees, and any legal fees for recouping a loss due to the bidder's negligence.
Reserves:
a) Any and all items that Harmeyer Auction & Appraisal Co., LLC. agrees to sell are subject to a reserve as per Indiana State Auction Law.
Documents:
a) All documents must be completed in full by buyers and sellers. For Example: Death Certificates, Letters of Authority, Creditor Leins, and UCC's when purchasing vehicles, firearms, etc.
b) All gun buyers will be required to fill out a 4473 form and pass a background check. Out of state buyers will be required to have any and all guns shipped to an FFL (Federal Firearms License) Dealer.
Compliance with the Terms of Sale:
a) In default of payment of bills in full within the time announced for this auction the Auction Company in addition to all other remedies allowed by law, may retain all monies received as deposit or otherwise, as liquidated damages.
b) Harmeyer Auction & Appraisal Co., LLC. is in complete accordance with Indiana statutes and Indiana Administrative codes, Title 25, Title 812, Department of Revenue Tax Bulletin #20, and Reference IC 6-2-4.
Warranties:
a) Everything is sold "AS IS/WHERE IS" with no warranties, representation or guarantees expressed, implied or otherwise given. All sales are final.
Conditions of Items Sold:
a) All information is believed to be accurate, but the auction company shall not be responsible for the correct description, authenticity, genuineness of or defect in any lot, and makes no warranty in connection therewith.
No allowance will be made or sale set aside on account of any incorrectness, error in cataloging or any imperfection not noted. No deduction will be allowed on damaged articles as all goods being exposed for public exhibition are sold "as is" and without recourse. Harmeyer Auction & Appraisal Co., LLC. requires any and all buyers to preview and make your own opinion of conditions.
Auctioneers have the right to refuse service or eject any person obstructing the auction process.
The record of sale kept by the Auction Company, the audio tape of the auction and the bookkeeper records will be taken as final in the event of any dispute.
Shipping/Pick up
a)All items must be paid for prior to pick up or shipping of the item
b)Pick up will be scheduled the following day after closing of the auction unless otherwise noted
c)If items are to be shipped the buyer will first pay for the item at the close of the auction. Then after payment has been made the items will be boxed and packaged for a fee of $5 per box. Then the card will be charged again for the shipping & handling fees and the items will then be shipped.
d)If the card is declined for the shipping fees the buyer will be notified and items will not be shipped until the shipping is paid in full.
e) if items are not picked up on the scheduled pick up day, they may be considered forfeited and no refund will be made.

Due to Mr. Sutton's health and moving to an assisted living facility we have been asked to lquidate the personal property and real estate. There will be a 2% Buyer's Premium added to the sale of the Real Estate. We are offering a 1700 sqaure foot home in Hartford City with a nice yard area and detached garge with small work area. Also, some nice household items that Mr. Sutton did not need at the facility. Double doors in front for storage. 28 Rock Salt Lamps Two rock salt lamps, boxes do come with lamps. Have not been tested, both do appear to be good. 29 Model Cars Three model cars, mostly plastic construction, are marked on bottoms. 30 Lexmark X1150 Printer Lexmark X1150 printer, copier, scanner unit. Comes with manual and cords. Have not been tested. 79 Stein & Terracotta Coasters Small German beer stein with lid as well as stack of terracotta coasters. 80 Foreign Currency Older foreign currency, majority appear to be Vietnamese with some other countries mixed in. Also comes with small menu and conversion table for Servicemen during the Vietnam Conflict for Sands Club in Tokyo. 81 Wallet & Watch Lot features 4 wallets most have been used with one with little to no wear. Comes with nice leather banded Timex watch. 82 Brass Lot features two what appear to be brass items. Nice large candle stick holder as well as a fluted bowl with handle. Also features two small brass appear bells (not pictured). 83 Figurines & Iron Cross Small lot of ceramic figurines by Homeco as well as a resin basset hound dog. Also comes with beautiful iron cross with stone. 84 Chest of Drawers Older set of chest of drawers, is dovetail construction, no manufactures name. Trim piece at base does need tacked back on. 85 Ironing Board & Iron Small metal framed ironing board and Black & Decker Iron. Has not been tested. 86 Window Fan Variable speed window fan by Lasko. Fits 27"-37" window. 87 Paint Tray, Scrapers & Paint Small lot of very nice plastic paint tray, scrapers and small amount of paint. 88 Card Tables & Chairs Two incomplete sets of card tables and chairs. One is brown in color has two chairs that match that table and other is green in color that has three that match that table. Buying all for one money! 89 Christmas Nice lot of several Christmas items. Comes with wrapping paper, ornaments, trees and older bulb type ornaments. Also comes with nice ceramic Christmas tree. 90 Clocks Older set of battery clocks, these all do need some repair. Comes with another set of hands. Do have damage and discoloration but overall good and complete. 95 Blackford County History Book Large Blackford County history book of the county. In good condition. 96 Purdue Debris 1984 1984 Purdue Debris yearbook, clean and appears to be complete. 97 1967, 68 & 69 Hartford City Retro Three Hartford City High School Retro yearbooks from 1967, 1968 and 1969. 1969 would be the last yearbook before moving to the consolidated high school. All appear to be good and complete. 98 Retro for 1959, 60, 61 & 64 Hartford City High School yearbooks for 1959, 60, 61 and 1964. All appear to be good and complete. 99 Retro for 1968 & 1969 These are duplicates for the past lots and offered these two by themselves. All appear to be complete and have some damage. 100 Vintage Jelly Cabinet Vintage jelly cabinet, dovetail construction, has been painted but think it will be an awesome refinishing project. In great condition. 101 Wards Chest Type Freezer Older Wards brand chest type freezer. Does work and is plugged in now, older unit but clean and working. 102 Wooden Shelves Several handmade wooden shelves for small items. These are made to hang on the wall for displaying items. 103 Dog Waters & Claw Trimmer Lot features two small dog waters with battery nail or claw trimmer. 104 TV & VCR's Small 13" tube type TV along with two VHS players, have not been tested. Will need to remove TV and leave wall mounting kit. 105 Night Stand Mid-Century modern nigh stand with drawer, appears to be good and nice color. 106 Heated Mattress Pad Heated mattress cover, still in package, doesn't appear to have been used. 107 Hospital Type Bed Small hospital type bed, is electrically controlled, does have rails with bed, has not been tested. 108 Wooden Stand Wooden night stand or end table, has drawer and door in front for storage. Does have some goo on the top but appears to be able to be cleaned. 109 Bed Sheets, Pillows & More Lot features a nice little throw rug, shower curtain cover, bath mats and several throws. 110 Wooden Duck Small wooden duck, not a decoy just a decorative duck. 111 Change Sorter Small plastic change sorter with sleeves. This will sort coins and wrap as well. Appears complete and comes with some sleeves. 112 Knight Statue Small knight statue, appears to be plastic or resin, is good. 113 Chest of Drawers Nice set of mid-century modern style chest of drawers, almost appears to be a maple color. Does math lot 119 114 Presidential Coins A set of gold colored presidential coin, on certificates and comes with small amount of coin holders. 115 Home Healthcare Items Small lot of some household type home health care items. Comes with oxygen level sensor, blood pressure cuffs, and humidifier for the bedroom. 116 Taser Small "over the counter" personal protection taser. Is battery operated and has not been tested. 117 Glass Marbles Small lot of older appear glass marbles. Does come with two small ceramic spheres. 118 Small Table Lamps Two small table lamps, have not been tested. 119 Dresser w/ Mirror Large maple appearing dresser with mirror, is a match to lot 113. Nice condition, YOU ARE BIDDING ON JUST THE DRESSER NO CONTENTS INCLUDED IN THIS LOT. 120 Shark Vacuum Cleaner Newer Shark brand vacuum cleaner, does have attachments and was told just purchased not too long before Mr. Sutton left the home. Very nice unit and does work. 121 Towels Lot of several towels, majority are bath type towels and all appear to be good. 122 Lantern & Oil Lamp Lot features a battery powered lantern and older oil lamp. No markings on oil lamp, does have reflector. 123 Bunt Pans Small let of 4 smaller bunt pans or jello mold pans, all appear to be good. 124 Cutting Boards Lot feature three cutting boards. One is wooden with cheese slicer, plastic for cutting veggies over the sink and rinsing, then finally we have a glass cutting board. 201 Show Lath Vintage show lath and extra horns. |
