Harmeyer Auction & Appraisal Co., LLC. retains the right to govern goods and services sold to clients and to maintain the level and integrity of our business. Harmeyer Auction & Appraisal Co., LLC. has the right to terminate the auction at any time; withdrawal from sale of any item; to sell at this auction items not listed; to group one of more lots into one or more selling lots or to subdivide into two lots or more selling lots. The auction company also reserves the right to sell all of the items listed in bulk.
Payment:
a) All payments will be required to be paid for with the credit card on file after auction is complete.
b) Buyer's Premium is 13% Online
c) Buyer specifically waves the right to dispute or deny payment for any purchases made with a credit card.
d) No items will be removed until they have been paid for. Purchaser is responsible for removal of all purchased goods. No abandonment of purchased items is allowed. All abandoned items will be sold for storage and moving fees.
e) Any gold & silver coins, precious stones and fine jewelry that are to be shipped anywhere will require wire transfer for payment.
Loading Equipment:
a) Buyer is responsible for their own removal of all items. Please bring any packing material and boxes that you may need. Please bring assistance to move heavy items to your vehicle and any tools for dismantling.
Pick up of Items:
a) All items must be on the scheduled pick up-date.
b) Outside of the Base Road Location-All Items must be picked up on the scheduled pick-up times. If they are not, they will be considered abandoned and become the possession of Harmeyer Auction, No Refund will be issued (10/7/2020)
c) Base Road Location: Any item remaining in our building 7 days after the scheduled auction pick up will be considered abandoned and become the possession of Harmeyer Auction, No Refund will be issued (10/7/2020)
No Liability:
a) Harmeyer Auction & Appraisal Co., LLC. assumes no liability for your purchases. The buyer assumes and does agree to indemnify and hold the auction company and seller harmless from any future claim that shall pertain to fitness or use of the asset being purchased.
b) Persons attending during exhibition, sale or removal of goods assume all risks of damage or loss to person and property and specifically release and indemnify the Auction Company from liability therefore. Neither the Auction Company nor his principal or seller shall be liable by reason of any defect in or condition of the premises in which the sale is held. Consignors & Bidders: a) All consignors must fill out a contract with Harmeyer Auction & Appraisal Co., LLC., sign forms and abide by our terms listed.
b) All bidders must register for bidder's numbers using proper ID or proper information.
c) Any employee of Harmeyer Auction & Appraisal Co., LLC. may bid at any auction if they wish to purchase an item.
d) All items become the sole responsibility of the purchaser when the auctioneer confirms your bid as the successful winner. We are not responsible for lost or stolen items.
e) If there is any dispute between two or more bidders, the auction company or its' auctioneer, may decide the successful bidder. The decision of the auction company, or its' auctioneer, shall be final and absolute.
Loss of Bidding Privileges:
a) If you have failed to pay for an item your bidding privileges will be revoked. Your privileges may be restored by paying for the item or repaying for the loss of the revenue due to the items not having been sold and by placing a credit card on permanent file whereby future purchases will automatically be charged.
Delinquent Accounts:
a) The bidder that has not paid for, or has not removed their items from the auction site, will be subject to the cost of storage, trucking, re-sale, deficiency balances, collection fees, and any legal fees for recouping a loss due to the bidder's negligence.
Reserves:
a) Any and all items that Harmeyer Auction & Appraisal Co., LLC. agrees to sell are subject to a reserve as per Indiana State Auction Law.
Documents:
a) All documents must be completed in full by buyers and sellers. For Example: Death Certificates, Letters of Authority, Creditor Leins, and UCC's when purchasing vehicles, firearms, etc.
b) All gun buyers will be required to fill out a 4473 form and pass a background check. Out of state buyers will be required to have any and all guns shipped to an FFL (Federal Firearms License) Dealer.
Compliance with the Terms of Sale:
a) In default of payment of bills in full within the time announced for this auction the Auction Company in addition to all other remedies allowed by law, may retain all monies received as deposit or otherwise, as liquidated damages.
b) Harmeyer Auction & Appraisal Co., LLC. is in complete accordance with Indiana statutes and Indiana Administrative codes, Title 25, Title 812, Department of Revenue Tax Bulletin #20, and Reference IC 6-2-4.
Warranties:
a) Everything is sold "AS IS/WHERE IS" with no warranties, representation or guarantees expressed, implied or otherwise given. All sales are final.
Conditions of Items Sold:
a) All information is believed to be accurate, but the auction company shall not be responsible for the correct description, authenticity, genuineness of or defect in any lot, and makes no warranty in connection therewith.
No allowance will be made or sale set aside on account of any incorrectness, error in cataloging or any imperfection not noted. No deduction will be allowed on damaged articles as all goods being exposed for public exhibition are sold "as is" and without recourse. Harmeyer Auction & Appraisal Co., LLC. requires any and all buyers to preview and make your own opinion of conditions.
Auctioneers have the right to refuse service or eject any person obstructing the auction process.
The record of sale kept by the Auction Company, the audio tape of the auction and the bookkeeper records will be taken as final in the event of any dispute.
Shipping/Pick up
a)All items must be paid for prior to pick up or shipping of the item
b)Pick up will be scheduled the following day after closing of the auction unless otherwise noted
c)If items are to be shipped the buyer will first pay for the item at the close of the auction. Then after payment has been made the items will be boxed and packaged for a fee of $5 per box. Then the card will be charged again for the shipping & handling fees and the items will then be shipped.
d)If the card is declined for the shipping fees the buyer will be notified and items will not be shipped until the shipping is paid in full.
e) if items are not picked up on the scheduled pick-up day, they may be considered forfeited, and no refund will be made.
f) If an item is shipped and damaged the buyer is responsible to file for all insurance claims
g) if an item is to be returned that will be done at the buyer's expense.

Due to the passing of Ms. Ella Jane Pompa, we have been asked by her daughter,Peggy Fisher to liquidate the personal property effects from the estate. This is very nice auction with many great items from Ms. Pompa over the years. We have also combined a small portion of items from Mr. Ed Hollander. Ed held many county governement positions in Blackford County over the years and had lived in Balckford county for many many years. Ed has now moved to Hertiage Pointe in Warren. Due to down sizing we have been asked to sell his remaining items.

There is a small amount of damage to one end, trim piece with feet have come... 53 Dirt Devil Hand Vac & Accessories A set of Dirt Devil brand hand vac, have not been tested, does come with a set of attachments, one does feature a hose. 54 Bissell ProForce Compact Vacuum A Bissell ProForce Compact vacuum, has not been tested, does appear to be complete, canister type cleaner. 55 Kenmore Progressive Vacuum Very nice and clean Kenmore Progressive vacuum. Looks new with very little use, comes with extra bags as well. Very nice has not been tested. 56 Garage Long Handled Tools This lot features a set of household type long handled tools. Comes with push broom, Black & Decker trimmers, ice scraper and more. 57 Household Long Handled Tools This is a nice set of more household type tools. Comes with mops, dust mops, brooms, plunger and many other items, all appear to be good. 58 (2) White Pressed Shelving Units Small two shelf units. These can be stacked or used individually, made from pressed wood, both in good condition. Measures 24" L x 11.5" W x 11.5" T 59 Baby or Doggy Gate This is a wooden framed with plastic type mesh covering. Is expandable, appears to be good and complete, measures 26.5" W be fore expanding, can expand to approx 50" wide, is 32" tall. 60 Drying Racks This lot has two dryer racks, one is metal and light weight, other is a wooden type, is a little loose but appears that it will work, does have discoloration from drying. Still usable. 61 Bathroom Items & Umbrellas Never get wet again! Here is a large selection of umbrellas, enough for one in every vehicle plus some spares for the house. Also comes with a some bathroom type items. Small trash can with lid, long shoe horn, storage and hair dryer. Hair dryer h... 62 Electric Heaters Very nice lot of several small electric heats, all are 110v, small and compact, great for the office or just to warm up your feet. 63 Wire Storage Two small wire coated drawer storage, also a set of wire hangers for the shower or tub, shelves do adjust on tub or shower organizers. 64 Laundry Time! A set up ready for any laundry room. Comes complete with an iron (Black & Decker), ironing board and hampers. Everything appears to be good, iron was not tested. 65 Sentry Safe Small home type Sentry brand safe, combination is included with safe, clean, small storage drawer at top as well. 66 Flexible Flyer III Sleds A set of Flexible Flyer II snow sleds, both are complete and in good condition. One does have a bent steering connection and missing a bolt. Great decor pieces or for the kids to have fun in the snow! 67 Baby Crib/Bed This is an assembled baby crib/bed, appears to be complete, does have small pouch with hardware. No mattress present juts frame and bed springs. Some damage to inside of rails. Very nice looking crib and looks to assemble easily. 68 Step Stools A one step and two step stool included. Both fold for easy storage, both appear to be sturdy and ready to use. 69 Pedestal Fan Pedestal fan with variable speed settings, does oscillate as well. Does have small crack in base does not seem to effect stability. Has not been tested. 70 Convalescent Items This lot features several convalescent or home health care items. All appear to be good and in usable condition. Several nice canes, one does appear to have sterling silver on handle, no official markings. 71 Lawn Carts This lot features several lawn chairs, all appear to be good, one is canvas type covering while the rest are all vinyl belting. Some extra belting for any repairs that need done. 72 Outdoor Table & Planter Nice small black expanded metal table, also with lot are small metal planter and what is believed to be a banner holder. All appear good. Table measures 18.5" L x 14" W x 17" T 73 Small White Patio Table This is a coffee style patio table, metal frame with expanded metal top. Round, appears good, does have some surface rust on bottom of the top. Measures 30" diameter x 16" tall 74 Live Trap Small like new live trap, complete and works as it should. Measurements are in pictures. 75 Rolling Tool Cart/Seat & Step Stool This lot has a nice small rolling seat with too storage, casters are complete and work as they should. Small two step stool or ladder, appears good and is by Rubbermaid. 76 AgriFab Lawn Spreader A AgriFab lawn spreader, does work, will need the tries aired up. It is complete, handle has been modified to open and close slot, Also for those small jobs, a Scott's brand hand seeder, does work and is plastic construction. 77 John Deere LA115 Lawn Tractor Very nice John Deere LA115 law tractor with 42" deck, does run and drive as it should. May need new battery. Hydro-static drive, good tires, features a Briggs 19.5hp engine. Ready to head to the yard! 78 Ames Lawn Cart Ames brand lawn cart, rolls easy, no holes or cracks, very nice lawn cart. 79 Metal Wheel Barrow Good and sturdy metal wheel barrow, good tires and handles are in good condition, no holes or cracks in tub. 80 Plastic Lawn Edging & Sprinklers A small amount of landscape edging as well as water sprinklers, nozzle and fertilizer applicator. 81 Aluminum Extension Ladders This lot features two aluminum extension ladders, one is a fair condition with some damage to bottom rungs, other is very good condition and is a Werner. 82 Small Plastic Dog House 2 piece plastic dog house, still in good condition, does have some discoloration from the sun but usable and lots of life left. 83 Lawnboy Lawn Mower Older 19" Lawnboy lawn mower, comes with new blade and blade level. Unsure of condition of mower, is 2 cycle. 84 Black & Decker Lawn Tools These are both 110v lawn tools, comes with a nice hedge trimmer that appear to have been used little and also a small 110v string trimmer, does have string in trimmer. Neither have been tested. 85 Troy-Bilt Pusher Mower/ W Honda Power Super clean Troy-Bilt push mower, has Honda engine, very nice, does have opening for bagger attachment. Handles do need tightened up do not appear to be bent. Does roll over but has not been started. 86 Stihl FS45C String Trimmer Stihl FS45C string trimmer, curve shaft, nice and clean. Has not been started, is complete and looks like its ready to work. 87 Fire Ring Cooker This is a tripod and 18" grate for cooking over the campfire or fire pit, all appear to be good and complete. Box still included. 88 Wooden Mechanics Creeper Older but nice mechanics creeper, wooden, casters are all complete and rolls as it should. 89 Galvanized Bucket & Porcelain Dish A good 10 qt galvanized bucket, does have some dents on bottom but bottom is good and comes with small white and red porcelain dish. 90 Tool Organizers This lot features a 5 gall bucket canvas buck organizer, great to throw your tools in for that job away from the shop. Also comes with a rubber made small tool carrier that works as a seat or step stool. Handle has been replaced on this. 91 Coolers A nice Igloo brand cooler with power unit, comes with 110v cord and 12v utility plug, has not been tested, older but very clean cooler. Also comes with small rolling soft cooler with Pioneer logo. 92 Luggage Multi piece luggage included in lot. Lot so of nice clean pieces. Red colored is full 3 piece set, may need to be cleaned up a little. All appear to be good and usable. 93 Kids Toys Nice small set of kid toys, features several puzzles, toy helicopter, tools kit and much much more. 94 Jazzy 1170 XL Scooter Jazzy electric scooter, comes with owners manual. Does have some ware on the are rests, has not been tested, does roll easily, appears to have light added to it. 95 Wheelchair Manual wheelchair, does collapse, appears to be good, rolls as it should, leg and foot rests as well. 96 Large Pet Carrier or Kennel Larger plastic pet carrier or kennel, does come apart, 4 pieces, has door and lock. 97 32 Gallon Rubbermaid Trash Can Nice clean Rubbermaid 32 gallon trash can with lid, has rollers, handles will lock lid down, very clean can. 98 Vintage Schwinn Exercise Bike Nice and clean vintage Schwinn stationary excise bike, has tension for added strain, very clean and works as it should. 99 Fireplace Kit Fireplace tools and stand, brush, shovel and poker, all appear good and in very good condition. 100 Outdoor Decor A small set of animals and an angel, both concrete and resin type construction. Tulips are wooden and in great condition. 101 Pole Saw Large limb or pole saw, appears good 102 Pipe Clamp Large pipe clamp, appears to be good, like new or almost like new condition, complete and works as it should. Approx 45" 103 Crockpots Two crockpots, both are very clean, no cracks or chips, complete. 104 Coffee Maker & Tea Maker Lot features a Black & Decker coffee maker, looks to be used very little and new model, comes with Mr. Coffee Iced Tea maker as well. This is complete with pitcher, also with lot is an extra coffee carafe. 105 Kitchen Appliances A nice set of kitchen appliances in this lot. Comes with a George Foreman grill with grease tray and 2 scrapers, very clean. Also with lot is an electric knife and electric knife sharpener. All appear to be good but have not been tested. Then fin... 106 Hamilton Beech Mixer Very nice and clean Hamilton Beech brand mixer with case. Comes with beaters, whisk and dough hook, has not been tested but very clean. 107 Porkert Meat Mincer/Sausage Stuffer Very nice and clean meat grinder and sausage stuffer, still in box and paper, looks to be used very little. Very clean! 108 PAMPERED CHEF 13" Round Baking Stone Appears to be unused. Comes in original box. Recipe and instruction book included. 109 Mirro Large Covered Roaster In original packaging. 17 1/4" x 12 1/2" x 8 1/2 Holds up to 22 lb fowl, 18 lb roast, or 22 lb ham. 110 Goethe-style Barometer Stands 13" tall and 6" wide. This wood, glass, and brass barometer is sure to draw attention! In overall good condition. 111 1992 Coca-Cola Straw Dispenser At just over 11" tall, this Coca-Cola straw dispenser has a heavy glass body and metal top & knob. In fine condition. 112 Heavy Duty White Porcelain Tea Kettle Stands at 9" tall, in very good condition. Brass handles with a large comfortable grip and a white 'whistler'. 113 Copper Tea Kettle Measures just over 8" tall with a 7" base, this kettle features a wooden handle and pull knob.
