Auction Rules, Policies and Procedures for a Cherry Hill Online Auction By registering to bid or placing a bid you agree to be bound by all of these terms & conditions and any other announced terms and conditions of sale or rules of the site and any rules set forth by the Georgia Auctioneer Commission. -All lots are sold ?AS-IS? ?WHERE IS? and All sales are Final. No refunds will be given for any reason. No Exceptions. -ll Internet Bidders agree to pay a Buyer?s premium as outlined in the Payment Instructions Section above. -Bidder?s bid at all times represents an irrevocable offer by Bidder to enter into a binding contract to purchase the lot in accordance with the specific provisions of the listing. -Payment of the winning bid amount, Bidder?s premium and shipping/insurance/confirmation charge will be made at the time the auction close by Cherry Hill Enterprises(from here on out in this document known as 'CHE') using the credit card on file with CHE -In consideration of CHE's approval of the application of the Bidder to bid in a CHE auction, Bidder hereby authorizes CHE to charge the credit card provided by Bidder to CHE as specified herein. A $50 handling fee will be assessed for each declined credit card transaction or chargeback and by bidding in this auction Bidder agrees to such charge. Requests for other payment arrangements will only be considered prior to the opening of bidding in any auction however a valid credit card must remain on file as a backup funding source. -Genuineness of a signature refers to the authenticity of the signature. Items that are sold with COA's or Certificates will be noted so in the item description. CHE makes no attempt to authenticate items that do not contain a COA or Certificate. Buyer should use their own discretion. -We DO NOT guarantee the authenticity on any of our lots. Please study photos carefully and Video, if live auction, during the auction as well as asking questions before bidding. Any description referring to a items authenticity or condition is completely the subjective opinion of CHE?s consignor and CHE makes no express or implied warranties based on the subjective descriptions of the items being sold. -Internet bidders acknowledge that they may not be able to inspect the lots beyond photo and/or video examination and additionally by questions submitted to CHE by telephone prior to the auction, and that such examination is not as good as if they examined it in person. It is the Bidder?s responsibility to determine condition, value or any other determinative factor prior to placing any bid. CHE shall strive to describe in detail each item and any pertinent information about it. CHE will not be responsible for any errors or omissions in the description of the merchandise unless it is a material, and intentional misrepresentation of the item itself. Bidder agrees that everything is sold ?AS IS? ?WHERE IS? and that they may not return any item they purchase for any reason. Bidder agrees that under no circumstances whatsoever will CHE ever be liable to any bidder for an amount greater than the purchase price of the item they purchased. This includes any shipping or other charges after the initial Auction Close -All sales are final, no lots are sold on approval; placing a bid is a legally binding obligation. There are no returns or exchanges. All lots are sold ?AS IS? ?WHERE IS??. Due diligence to verify the condition and description of a lot is the sole responsibility of the Bidder prior to placing any bid. A restocking charge of 25% of the full invoice amount may apply in CHE's sole discretion. Any allowed returns must be received in exactly the same condition as when originally shipped to Bidder, or they will be returned to Bidder at Bidder?s cost. Any unauthorized returns will be refused. Bidder agrees that under no circumstances whatsoever will CHE ever be liable to any bidder for an amount greater than the purchase/hammer price of the item they purchased. -By signing up to participate in a CHE auction, Bidder specifically agrees that any dispute shall be governed, construed, and enforced in accordance with the laws of the State of Georgia, without regard to its conflict of laws rules. In the event that Bidder violates any provision of these terms of sale, in consideration of CHE's approval of the application of the Bidder to bid in CHE's auction, Bidder confesses judgment to fraud having been committed by Bidder against CHE and further agrees that Bidder is liable to CHE for all damages, losses, costs, interest at the rate of 18%, attorney fees, including time charges, resulting. -There are no provisions for the placing of bids to 'mark the lot' or to 'test the system', etc. and any requests to cancel bids on these bases, or due to a Bidder not reading a listing, not being familiar with the bidding platform, not doing proper due diligence or failing to maintain proper control over Bidder?s bidding terminal, will be denied. Such requests to cancel bids are null and void and will not excuse Bidder from Bidder?s legal and contractual obligation to complete a transaction. -If you are the successful Bidder, you agree to pay the amount of your bid plus all applicable taxes, buyer's premium, shipping, insurance, delivery/signature confirmation, and charges in the time and manner designated by CHE. Failure to make such payment shall be deemed to be a breach of these general terms and conditions, and, in addition to all other rights and remedies CHE may have under applicable law, you will be charged a re-stocking fee on transactions equal to (a) 25% of the amount of your invoice, plus $50; or (b) the cost associated with re-marketing and re-selling the lot, whichever is greater. -Bidder is responsible for any and all costs associated with collection of amounts owing from the Bidder, until collected; and CHE reserves the right to bill and collect any such costs from Bidder. Costs associated with collection may include, but are not limited to, time charges, incidental expenses, interest at the rate of 18%, attorney fees and costs associated with the use of a collection agency. -The winning Bidder?s failure to complete the purchase in accordance with the terms provided herein and in the listing will cause the Bidder to be faced with all, or any combination of the following measures: elimination of all future bidding privileges on the hosting site; credit agency reporting; legal and/or collection action. -These terms and conditions and each listing contain all of the provisions applicable to the agreement between CHE as seller and each Bidder. The provisions of these terms and conditions and of each listing supersede all other agreements, representations or understandings, whether prior or contemporaneous, oral or written, between the parties concerning that subject matter. These terms and conditions and provisions of each listing shall be binding on Bidder?s heirs, beneficiaries, executors, successors and assigns. By bidding in this auction Bidder agrees that the State of Georgia shall have jurisdiction over any and all claims arising out of this agreement. -If any provision of these terms and conditions or of any listing shall be deemed void, unlawful or unenforceable under applicable law, that provision shall be modified to the minimum extent possible to comply with applicable law, or if modification is not possible, deleted and severed from the remaining provisions. Any such modification, deletion or severing shall not affect the enforce-ability or validity of any of the remaining provisions. -CHE is providing Internet pre-auction and live bidding as a service to Bidder. Bidder acknowledges and understands that this service may or may not function correctly the day of the auction. Under no circumstances shall Bidder have any kind of claim against CHE or anyone else if the Internet service fails to work correctly before or during the live auction. CHE will not be responsible for any missed bids from any source for any reason. Internet bidders who desire to make certain their bid is acknowledged should use the proxi-bidding feature and leave their maximum bid 24 hours before the auction begins. CHE reserves the right to withdraw or re-catalog items in this auction. CHE will do its best to describe each lot. Bidder acknowledges that errors in descriptions may occur and if the photo of the lot is different than the title or description of the lot, Bidder shall contact CHE for clarification. If Bidder fails to make such clarification of the lot with CHE during normal business hours of 11:00am-5:00pm EST Tuesday through Friday, Bidder accepts the lot as is, regardless of the unintentional listing error. -The auctioneer shall advance the bidding at his/her own discretion. CHE may withdraw any item before or during the auction. In the case of two bidders having a tie bid on an Item when sold the Auctioneer at his sole discretion will decide the winning bidder. Bid will not reopen on any item for bids based on tie bids. The record of the auction made by CHE shall be conclusive. -CHE reserves the right to refuse a Bidder?s number to anyone for any reason. Bidder agrees to provide any identification CHE may request including but not limited to: driver's license, photocopies of credit cards, Social Security card or US Passport. Bidder agrees to comply with any stated additional terms or conditions associated with particular items. -By bidding in this auction you authorize us to add you to our email distribution list and send you blast emails about our upcoming auctions. You are free to unsubscribe from this email distribution list. List are for the sole discretion of CHE for future advertising purposes. We do not sell our clients information. CHE does not store credit card information. Any credit card registered with Live Auctioneers is collected and stored by LiveAuctioneers, not CHE.
