Listing Terms and Conditions
Terms: 10% non-refundable deposit down the day of sale with balance and possession upon closing. Bidding is not contingent upon inspection or financing. Seller has no knowledge of any environmental factors that would have a negative impact on the property. Taxes: Buyers to assume taxes due and payable in the Spring 2019 and thereafter. Possession: At closing. Ten percent of final bid price due to Wagner Auctioneering and Real Estate within 48 hours of auction close. Bidding is not contingent upon financing or inspection. Buyer agrees to enter into a purchase agreement embodying the terms within 48 hours of auction close. Seller, at closing, shall deliver to Buyer marketable title to the above described real estate, subject to the terms of this Agreement. Prior to closing, Seller, at Seller's expense, shall deliver a title commitment to the real estate showing marketable title in the name of Seller, except for current real estate tax liens restrictions and easements of record and gas storage leases of record. Seller shall convey title to the real estate by warranty deed subject to the first installment of 2018 taxes and assessments due and payable in 2019 and all taxes and assessments due and payable thereafter, restrictions and easements of record and gas storage leases of record. Seller is selling the said real estate to Buyer free and clear of all liens and encumbrances except the taxes due and payable in the Spring of 2019 and thereafter and except restrictions and easements of record and gas storage leases of record. Buyer agrees that if for any reason Buyer does not pay the unpaid balance of the purchase price at closing, the 10% down payment will not be refunded to the Buyer. Buyer's obligation to close this transaction is not contingent upon inspection or financing. This 10% down payment will be deposited and maintained in the auction company's escrow account until the time of closing. Buyer's obligation to close this transaction is not contingent upon inspection or financing. In the event that Seller cannot deliver to Buyer, at closing, marketable title the auction company will refund to the Buyer the full amount of said down payment from the auction company's escrow account and the return of said down payment shall be Buyer's sole and only remedy. Closing Costs: Seller is responsible for any costs incurred to provide marketable title subject to the terms of this Agreement. Buyer is responsible for any costs incurred to obtain financing.
