BANK LETTER CONFIRMATION of FUNDS: Upon successful registration you will be approved for bids up to and including $5,000. Any bids submitted over $5,000 will remain "Pending" until Jones Auction & Realty Service, LLC receives a Bank Letter Confirmation of Funds. This letter must include the bid permission amount you are requesting. Your letter may be faxed to (920) 261-6830 or emailed to: info@jonesauctionservice.com Once received, you will be given bid permissions up to and including the dollar amount on your letter. 1. Your bid along with these terms creates a legal binding contract between you, Jones Auction Service, Jones Auction & Realty Service, LLC. All items sell As Is, Where Is, No Exceptions and No guarantee or warranty. 2. 16% Internet Premium and 5.5% Wisconsin Sales tax applies. All licensed items: vehicles, trailers, motorcycles, etc. will be charged sales tax. TAX EXEMPT STATUS: If you are claiming tax exemption a copy of your certificate of exemption is required to be on file at Jones Auction & Realty Service, LLC, 818 North Church Street, Watertown, WI prior to the close of the sale or tax will be applied to your purchase. You must notify us prior to the close of the auction if alternate payment method is preferred. We accept cash, Visa or MasterCard for purchases up to $5,000 and wire transfers for any amount, wire transfers will incur at $20.00 processing fee. Wisconsin State Sales tax applies unless certificate of exemptions are on file at our office prior to the end of the auction. Sorry, no personal checks, money orders or out of state checks accepted. Cashier's check only accepted with prior submitted Bank Letter Confirmation of Funds and no items will be released until the cashier's check clears the bank. 4. Online/Internet bidding only- Under no circumstances shall the bidder have any kind of a claim against Jones Auction & Realty Service, LLC; the seller; the internet bidding platform company; or anyone else if the internet service fails to work correctly or if the bidder does not use the Live Catalog option when the lots start to close, or for any computer interruptions. 5. All bidding will be online/internet bidding only at www.jonesauctionservice.hibid.com and requires a valid credit card to register, Visa or MasterCard accepted. Upon registering you will be approved for bids up to and including $5,000. For bid permissions over $5,000 please refer to the Bank Letter Confirmation of Funds instructions found at the beginning of these Terms and Conditions. 6. Buyer is responsible for the complete removal of buyer's purchases and accepts full responsibility for any personal injury to himself or his agents and any property damage incurred on pick up premises. Seller, auctioneers and buyer expressly agree that the buyer is responsible for and agrees to indemnify seller, auctioneers and their respective affiliates for any and all damages (whether based on contract, tort, warranty, negligence, strict liability or any other legal theory, and including special, incidental and consequential damages), losses, expenses, attorney's fees, court cost, etc. that arise out of or result from the removal, possession or use of any items purchased at auction, or any other claim regarding the use or possession of any asset purchased at auction. Your bid is a legal binding contract between you and Jones Auction & Realty Service, LLC. All sales are final and sold As Is, Where Is, without warranties or guarantees of any type and with all faults-No Exceptions. Auctioneers and seller expressly disclaim and exclude the implied warranties of merchantability and fitness for a particular purpose. Bidders should satisfy themselves as to the usefulness and value of each item. Any statement in the description regarding the items to be sold should be considered a guide and a guide only. Any error in description does not relieve the buyer or his/her agent of their responsibilities. We make every effort to provide complete and accurate descriptions of all items offered. You are responsible for your own inspection during scheduled preview dates. No warranty of quality, condition, merchantability, or fitness for intended use is given. Buyer assumes all risk of loss or damage while equipment is on our premises or in our possession. 7. All items are offered for sale to qualified purchasers without regard to prospective purchasers' race, color, gender, marital status, religion or national origin. 8. Auctioneers are licensed by the Wisconsin Department of Licensing & Regulation. 9. All buyers must acknowledge and accept the Terms and Conditions provided at the time of online registration. Your bid is a contract to purchase should you be the winning bidder. Absolutely NO REFUNDS. We make every effort in preparing the catalog to provide accurate descriptions of all items. At the close of the sale, Jones Auction & Realty Service, LLC will send your invoice/receipt to the email address used to register. Your invoice/receipt will include the total winning bid price, the 16% Internet Premium, the 5.5% Wisconsin Sales Tax and if applicable a $20 wire transfer fee. Payment is due in full upon receipt of your invoice and within 24 hours of the close of the sale. (Please see Shipping Options if you are requiring shipping services). PAYMENT: 1. Credit cards will be charged following the close of the auction for the invoice total, internet premium and 5.5% WI sales tax unless bidders notify us prior to the end of the auction of their desired payment method. No items will be released until payment is made in full with cleared funds- No Exceptions. Cash; Visa or MasterCard for purchases up to and including $5,000 and wire transfers accepted, wire transfers will be assessed a $20 handling fee. Call for instructions if this is your preferred payment. Sorry, no personal checks, money orders or out of state checks accepted. Cash payments accepted when you pick up your item(s). No credit card or wire transfer payments accepted at pickup location. TITLED VEHICLES: If paying for a titled vehicle with cashier's check, no titles will be given to buyer until funds clear through the financial institution after the check is deposited. 2. At the close of the auction, Jones Auction & Realty Service, LLC will send out your invoice/receipt to the email address used to register. You will be invoiced for your purchase, the 16% Internet Premium, the 5.5% Wisconsin Sales Tax, and any applicable transaction fees. Any items not picked up by the end of the day of the last scheduled pick up date or by appointment shall be forfeited by the buyer and will no longer be considered their property unless prior arrangements are made. However, the bidder shall still be responsible for the final bid price of the items that were bid on plus the 16% Internet Premium, the 5.5% Wisconsin Sales Tax, and any applicable transaction fees. NO REFUNDS will be given. PLEASE NOTE: A $25 service fee will be charged to any account whose credit card on file is declined and requires additional time and telephone contact to establish payment for merchandise. Please contact our office immediately at (920) 261-6820 if you know that you need to use an alternative credit card. **Special Terms Apply for Firearm Sales**: At the close of the sale, purchased firearms will be taken to Watertown Trade & Auction for all FFL paperwork. Local buyers wishing to pick up your firearm(s) directly from Watertown Trade & Auction will be charged $20 for the first firearm and $10 for any additional firearm payable directly to Watertown Trade & Auction. Non-local or out-of-state buyers: A $25 handling and processing fee per firearm along with a flat shipping charge of $35 per firearm will be incurred and is the buyers responsibility payable directly to Watertown Trade & Auction. Firearms will ship USPS. Watertown Trade & Auction accepts Visa, MasterCard and Discover with a 3% transaction fee. Watertown Trade & Auction is located at 204 N Water St, Watertown, WI 53094. Main Street, Juneau, WI 53039 at the scheduled times only. Jones Auction staff members will assist customers when picking up items. Firearms are to be picked up at Watertown Trade and Auction during their normal business hours following successful completion of all necessary paperwork. PICKUP NOTICE: All purchased items MUST be picked up on scheduled pickup date(s) and time. Failure will result in forfeited items. Alternate arrangements, including transfer to our 818 North Church Street, Watertown location must be made with the auction company prior to 4:00 p.m. on the last business day before pickup time as listed in the auction catalog and Terms and Conditions. Items requiring transfer will incur a $5.00 per item service fee up to $20.00 per bidder. No Exceptions SHIPPING AVAILABILITY and OPTIONS: Shipping is available on select items as noted in catalog at buyer's expense. Select items, up to 70 pounds, will be available for shipping if required with all packaging and shipping charges the responsibility of the buyer. UPS shipments are insured for $100 and USPS shipments for $50 at no extra charge. Any desired additional insurance will be charged to the buyer and it is the buyer's responsibility to notify us at the close of the auction if you desire additional shipping insurance. Buyer is responsible for all packaging, handling fees and shipping costs. Your credit card on file will be charged for any shipping incurred costs. 3. We ship 7-10 business days after the close of the sale. HANDLING FEES: Small sized items: $5.00 Medium sized items: $10.00 Large sized items: $20.00 It will be the decision of the auction company to determine the handling fee charged.
