You must be 18 years of age or older to bid. By registering and bidding on any item, the bidder/buyer shows acceptance of the following terms and conditions. Do not register or bid unless you agree to all of the terms and conditions listed. All information provided during registration must be current, complete, and accurate. Duncan Auctions may deny or ban any registration to any person at any time. By using this site, you are agreeing to the terms and conditions listed below.
Disclaimer: All items are sold "as is, where is" with no guarantees. Duncan auctions encourages bidders to inspect lots in person before bidding. Duncan Auctions and the seller/sellers do not give or make a guarantee on items being sold. Duncan Auctions puts forth every effort to provide accurate information in the description of the items/lots being sold. It is the bidder's responsibility to determine the condition/worth of each item/lot being bid on before they place their bid. A bidder's failure to inspect before bidding, does not qualify the bidder for a refund, adjustment on price bid, or a refusal to close a sale. No bids can be withdrawn after the auction for any reason.
DEPOSIT: A non-refundable deposit of $5,000 is required from the buyer within 48 hours of the auction end date/time. The deposit is delivered to Seller to evidence Buyer's good faith. In the event that the closing does not occur for any reason whatsoever, other than solely due to the fault of the Seller, Seller shall retain the deposit as a measure of liquidated damages. This provision shall in no way affect the right of the Seller and Auctioneer to rely upon and to exercise any other legal remedies or recourse available to them, including without limitation seeking specific performance or monetary damages, in event the closing contemplated herein does no occur due to default by Buyer, Buyer further agrees to pay all attorney fees, court costs and other costs of collection/enforcement incurred by Auctioneer and Seller due to a default by Buyer.
NOTE: If you are the successful bidder, you must sign all the purchase agreements and make your deposit ($5,000 down) on the property within 2 business days of the conclusion of the auction.
Refund policy: No refunds, returns or exchanges are permitted for any reason. ALL ITEMS/PROPERTIES ARE SOLD AS IS, WHERE IS, WITH NO GUARANTEE ON CONDITION OF ITEMS/PROPERTIES. Please take the time to inspect all items/properties before bidding.
BIDDING TERMS: Duncan Auctions will set the guidelines for bidding increments. Duncan Auctions reserves the right to reject any bids for any reason. Current posting/starting time and closing times of auctions are approximate and Duncan Auctions reserves the right to close early or extend hours of auctions. It is strongly encouraged to bid early as to not miss out on last minute bids. All decisions made by Duncan Auctions are final.
Please note: Duncan Auctions reserves the right to extend bidding, continue bidding or close the bidding related to technical issues that may arise including software, server, internet or any other online auction related technologies. Duncan Auctions and the company providing the software shall not be held accountable/responsible for any technology related failures before, during or after auctions.
MAX BID: Max bid is the highest amount that you are willing to pay for the item/lot listed. The current bid price does not automatically jump to your max bid, unless there is a reserve. Your bid will go to the highest increment as other people bid against you. The computer will automatically bid these increments up to your max (Duncan Auctions will have the increments listed prior to auction). By placing any bids, you have agreed by legal contract that you are willing to pay what you bid for your max. The buyer agrees and is responsible for every bid amount placed. Keep in mind, buyers premium is being added to final price of item(s). Please bid accordingly.
BUYERS PREMIUM: An 8% buyers premium is charged by Duncan Auctions. When you put in a bid, it will calculate the buyers premium before you hit submit. Auction Zip charges 1% as their fee and this will be calculated into the above amounts and you will see this total amount before hitting submit on a bid. What you see on your screen as "buyers premium" is the total amount of ours and theirs added together.
PAYMENT/ TYPES OF PAYMENT: All buyers MUST pay for their purchases in full within the scheduled dates listed by Duncan Auction after the conclusion of the auction. Cash, checks, money orders, cashier's checks, major credit/debit cards are accepted. All credit cards will have a 4% processing fee added as we are charged this to process the card. Make checks payable to: Duncan Auctions LLC. Items/lots become full responsibility of bidder/buyer at time of payment.
CLOSING: The Sale of the Property shall be closed within ten (10) days after all necessary papers are ready, but not later than 30 days after the auction date. If their are delays in closing due to title work, or title defects, thirty (30) more days shall be allowed for closing. The closing costs shall be split evenly between the buyer and the seller.
Important note:
Your bid is a legally binding contract, no exceptions. The winning bidder agrees to indemnify Duncan Auction's company, auctioneer, auctioneer employees, etc. from all claims, fees, judgments, expenses, disputes, legal fees etc. By using this site, you are agreeing to all terms and conditions listed above.
Buyer represents that an inspection satisfactory to Buyer has been made of the Property, and Buyer agrees to accept the Property in its present condition except as may be otherwise provided in an attachment to this agreement and acknowledged in writing by Seller and Auctioneer. Buyer acknowledges that neither the Seller nor the Auctioneer makes any representation or warranty concerning the Property, its zoning, uses, or descriptions of the Property. Purchase agrees to accept the Property, 'AS IS WHERE IS WITH ALL FAULTS.' Buyer acknowledges they were encouraged to conduct their own investigation and due diligence to determine if they should purchase the property.
Seller is selling the Property by deed description only, it being understood and agreed that the acreage / square footage of the property is NOT guaranteed or warranted in any way by Seller or Auctioneer. In the event Buyer and/or Seller require a survey of the Property, Buyer shall provide the survey at Buyer's risk and expense. Upon approval of survey by Seller and Auctioneer, the legal description contained on said survey shall be substituted for the legal description, if any, attached to this Auction Contract of Purchase and shall be the legal description utilized in conveying the Property from Seller to Buyer.
BUYER AGREES TO PAY ALL INSPECTIONS, TRANSFER and
RECORDING FEES. TIME IS OF THE ESSENCE. Escrow and title insurance is available at buyers' option and expense. All taxes, interest, rent and escrow deposits, if any, shall be pro-rated as of the date of settlement.
