PLEASE READ CAREFULLY. These terms and conditions are absolute and cannot be altered or changed in any way except in writing by the auctioneer. Bidder agrees that the terms listed below shall govern this auction. If you cannot follow these terms 100%, you are welcome to stay as a spectator, but do not bid. BUYERS PREMIUM: A 13% buyers' premium is added to the high bid to establish the final invoice price. 3% is waived with cash or check payments. REGISTRATION: You must be at least 18 years old to register and participate in this sale. You agree that all information provided during registration is true, accurate and up to date. SETTLEMENT: All items must be paid for in full before bidder leaves the premises. Nothing may be removed until it is settled for. All items must be paid in full on the day of the auction via cash, certified check, money order, or personal check. Funds must be cleared prior to removal of titled vehicles. A $30 fee is charged for all returned checks. In the event of non-payment of bad check, the auctioneer reserves the right to repossess, at any time, at your location, the merchandise involved. ALL SALES ARE FINAL: No returns or exchanges are accepted once the Auctioneer accepts the buyer's final winning bid. Once the item is sold, the winning bidder becomes the new owner of the item and has effected a legally binding contract which cannot be altered or voided. NO WARRANTIES: All items are sold as is, where is without warranties or guarantees, expressed or implied as to the quality, character or condition. The descriptions of items appearing in advertising prior to this auction are believed to be correct. Nonetheless, neither those descriptions nor any oral statements made by the owner (or his agents or officers), or the auctioneers (or his agents or officers) concerning any items shall be construed as a warranty. I, the bidder, have examined this merchandise and accept it the way it is. DISPUTES: The auctioneers shall designate the winning bidder after each item is auctioned. Once the auctioneer designates the winning bidder, bidding cannot be reopened. BUYER'S RESPONSIBILITY: After a bidder has won the bid with his/her high bid, they have become the new owner of the item(s), even though they may no have paid for the item yet. The item(s) become the full and sole responsibility of the buyer at this point, and buyer assumes all risk of loss and damage. Buyers should guard their items accordingly. INJURY & DAMAGE: Bidder acknowledges responsibility for any personal injury or property damage caused by bidder or his agent, and further agrees to hold auctioneers and sellers harmless from any personal injury to himself or his agents and any property damage incurred on auction premises. All bidders and their agents enter the site, participate with the auction and remove items at their own risk. Professional removal is recommended. CLAIMS: Any claims or disputes arising out of these terms and conditions or this auction will be settled in Lucas County, Ohio. AGENTS ONLY: The auctioneers and agents/staff are acting as the owner's agent only. REMOVAL TIMES: Day of sale. Titled vehicles and tractor within 7 days & upon cleared funds. Any outside shipping or delivery arrangements must be handled exclusively by the high bidder.
