Complete online registration is required to bid. All bidders must be 18 years of age or older to bid. By registering to bid or placing a bid you agree to be bound by all of these Terms & Conditions and any other announced Terms & Conditions or rules of this auction.
All items are "SOLD AS IS, WHERE IS '' and ALL SALES ARE FINAL! All items should be considered untested unless otherwise noted. There are no returns, exchanges, buybacks or refunds. Item inspection dates are listed. Bidder waves their right to a chargeback and agrees that they will not charge back on any credit/debit card purchases.
A 10% Buyer's Premium will be charged on each invoice Sales Tax will be collected.

A 3.5% convenience fee will be added for: PayPal, Mastercard, Visa, Discover, American Express or via electronic Invoicing through PayPal. We encourage you to place you to place your maximum bid so you won't lose out on what you want. When a max bid is placed, the current bid price will not automatically jump to your max bid. Another bidder has to bid to increase the current price and the computer will automatically bid for you in the next increment, continually AFTER being outbid, until it reaches your maximum bid amount. Your max bids can only be seen by you. If you should have a question about an item, please contact us before bidding.
Auction Closing: The online auction will feature a Staggered Closing. When bidding ends for the first lot, one additional lot will close every 20 seconds thereafter. If a bid is placed on a lot within the last two minutes leading to a lot's scheduled close, a Dynamic (soft) Closing will occur. This will automatically extend closing by an additional two minutes whenever a bid is placed until no additional bids are made for two minutes.

Registration: To gain access to this online auction, you will need to register and create a Hi-Bid username and password. You must be eighteen years old or older to register. You agree that all information that you provide during the registration process will be true and accurate. You will be banned from participation in the Auctioneer's auctions indefinitely should you provide any false information during the registration process. Echo Valley Trading Company LLC may refuse registration or a bidder number to anyone for any reason.

Sales Tax: Sales tax will be collected on the total hammer price for all lots at the rate of 9.475%. Resellers or Non-Profits with a Missouri Tax I.D. may provide a properly completed Missouri Department of Revenue Sales and Use Tax Certificate (Form 149) to Echo Valley Trading Company LLC to receive a tax exemption. Bidder's Duty to Investigate: You are bidding based on the description and photos provided. Carefully inspect the description and photos for condition and finish. We make every effort to disclose flaws that may not be a result of ordinary use. However, we may not notice all imperfections. Common nicks, scratches and wear may not have been called out. You may contact the Echo Valley Trading Company for additional photos or specific information about an item before placing your bid. If you are not certain of the condition, completeness or suitability of a given item, please bid accordingly. All items sold "As Is, Where is" without warranty expressed or implied.
Photographs and Descriptions: The Auctioneer regularly posts item descriptions and photographs to aid bidders in the bidding process, and we make every effort to ensure that the descriptions and photographs that we post accurately represent the items being offered for sale. Also understand that, on occasion, the wrong photograph may be displayed for a given item. At all times, you are bidding on items as they are described on this auction website, not as they appear in any photograph. For demonstration purposes, various equipment may be joined. Bid Wisely: We want everyone to be pleased with their purchases and most will. However, when you bid on the wrong item or decide an item is not suited for your intended use, We will not reverse your bid nor assume the cost of your mistakes. You agree that your failure to become fully informed about the items offered for sale in this auction will not be grounds for a refusal to pay amounts due to Echo Valley Trading Company LLC nor for any claim against the Auctioneer. Bidder shall be the sole judge of value.
Auction Closing: This online auction will feature a Staggered Closing (soft) with the first lot at the scheduled closing time and one additional lot will close every 30 seconds thereafter. If a bid is placed on a lot within the last 3 minutes leading to a lot's scheduled close, a Dynamic Closing will occur. This will automatically extend closing by an additional 3 minutes whenever a bid is placed until no additional bids are made for 3 minutes.
Notification: If you end up placing one or more winning bids in this auction, Echo Valley Trading Company LLC will contact you by email to let you know which items you have won. Due to the electronic nature of this auction, invoicing or email delays may occur. This e-mail notification will be the only contact you receive from the Auctioneer about your winning bids; this means that you are responsible for checking your email following the close of the auction to determine what items you have won.
Possession: Buyers cannot take possession of or remove their purchases from the auction site until the total purchase price (including applicable taxes or fees) has been paid in full. All items must be removed during the defined dates and times of auction pick up. Failure to pick up and pay for items, the items purchased shall be deemed abandoned and the buyer will lose any rights, title, or interest of items. Those items may be resold to recover expenses and costs.
SHIPPING: Our priority is to deliver your new purchase in excellent condition. Echo Valley Trading Company LLC will wrap, package and weigh items to be shipped. An additional packaging/handling fee will apply. Packages will generally ship through USPS, FedEx or UPS. Buyer will be solely responsible for remitting payment for any and all shipping costs including any pick up fees, postage fees, packing, handling, tracking, insurance, crating fees and any other associated costs directly to the auction company. Packing, shipping and insurance costs may be quoted before shipping, if possible. All items will be insured for the purchase price. PLEASE NOTE THAT NOT ALL ITEMS ARE ELIGIBLE FOR SHIPPING. Only small items will be shipped. If you are not for sure if an item is available for shipping, please contact our office before bidding. If your item(s) are available for shipping and you want them shipped, you must notify Echo Valley Trading Company LLC. within 24 hours of the auction ending. In addition to your purchase price, you will be charged separately for the cost of shipping and the shipping materials as outlined in the payment instructions. The 3.5% convenience fee for electronic payment will be applicable to these additional charges. There will be no international bidding/shipping available. If you register for the auction and are not in a Jurisdiction that a firearm can freely and legally be shipped to, your bidding account will be revoked.

The Auctioneer reserves the right to, at any time add or remove items from the auction, split or combine lots, make changes to the auction's dates, beginning, ending or preview times. Auctioneer may take any other action deemed necessary to effect the fair conduct of this sale or protection of buyers', sellers', or other parties' interests. Server & Software Technical Issues: In the event there are technical difficulties related to the auction server, software, loss of power, internet connection or any other auction related technologies, Echo Valley Trading Company LLC reserves the right to extend bidding, continue, extend or close the bidding.

Bidder's Duty to Report Fraud: Protecting your account is important. You are responsible for all bids made from your account. If you believe that an unauthorized person has gained access to your account, you must notify the Auctioneer immediately by sending an email to echovalleytradeco@gmail.com and call our office immediately. You must also report the incident to the relevant law enforcement authorities and send the Auctioneer a copy of any resulting police report. If you fail to follow these procedures you will be held personally responsible for all purchases made using your account and bidder number.
Liability: In all cases, the Auctioneer's liability, and the liability of the seller of the items in this auction, will be limited to the refund of your purchase price. The Auctioneer will not be liable for any amount in connection with the postponement or cancellation of this auction, or the withdrawal of any item or lot from this auction. In no event will Echo Valley Trading Company LLC be liable for lost profits or any special, incidental, or consequential damages arising out of or in connection with this auction or any related sale or transaction.
Indemnification: Purchaser does hereby indemnify and hold harmless Echo Valley Trading Company LLC, the Auctioneer and Seller from any and all damages, claims or liabilities from injuries to persons or property of any type whatsoever caused during the sale or by the removal of items purchased. Purchaser assumes all risk and liability whatsoever resulting from the use of the item(s) sold hereunder; and shall defend, indemnify, and hold harmless Auctioneer and Seller from any liability.
Default: If the foregoing conditions or any other applicable conditions are not complied with, in addition to other remedies available to Echo Valley Trading Company LLC, Auctioneer and Seller by law, including without limitation, the right to hold the purchaser liable for the bid price, the Auctioneer, at their option may (1) resell the property publicly or privately, with purchaser being liable for the payment of any deficiency plus all costs incurred, or (2) cancel the sale, retaining liquidated damages on all payments made by purchaser, Auctioneer commission and all other incidental damages will be charged.
Governing Law: These Terms and Conditions will be governed by and construed under the laws of the State of Missouri.
Entire Agreement: These Terms and Conditions contain our entire agreement and supersede any prior oral or written agreements relating to the same subject matter.
