Auction Terms & Conditions Watson Online 1. All items offered for sale at the Auction will be subject to the following Terms and Conditions. 2. Auctioneer makes every effort to provide accurate information about the items being sold. The Auctioneer and the Seller will not assume responsibility for Buyer's bidding errors. Descriptions and photos are offered as a guide only. Part numbers that are in the pictures were not created by the auction company. Do not rely solely on photos to make buying decisions, be sure to read descriptions and use Buyers resources to research your items. It is Buyers' full responsibility to confirm the accuracy of items offered for sale. 3. Bidder understands and agrees that this agreement and all rights of the parties shall be governed by the laws of the State of Tennessee and in the jurisdiction of Jefferson County, TN. Any and any action brought by either party shall be brought in the courts of the State of Tennessee. In the event, that for any reason, the forum is deemed to be sufficiently inconvenient or the agreement on the forum selection is unenforceable it is still the intention of the parties that the Laws of the State of Tennessee govern the parties agreement and their rights attended thereto. Buyer agrees that any legal filed action will take place within the County of Jefferson, City of Dandridge, State of Tennessee. 4. A successful bid at this online auction constitutes a legally binding contract of sale. There will be no refunds, returns or exchanges. All sales will be final. 5. The condition of the items being offered varies. The Buyer understands and agrees that any description of the item by the Auctioneer is given as a courtesy and that there is no warranty expressed or implied as to the accuracy of the description or item. 6. All items purchased in this auction are being sold "AS- IS" "WHERE-IS" and with any faults that may or may not exist. Auctioneer makes no warranties or guarantees, whether written or expressed as to the quality, authenticity, quantity, condition, usability, salability, weight, measurement, year, make, model, part number, mechanical condition, performance or any other specifications including but not limited to any warranty or merchantability or fitness for a particular purpose. Auctioneer has no idea whether the product carries any manufacturer warranty as most of these products have been on the shelf for a long period of time. 7. The Buyers bidder number is nontransferable. All bids online made using the bid number will be the responsibility of the Buyer. 8. In the event items are not removed during the allotted pickup times and days then the items purchased shall be deemed abandoned and the Buyer will lose any right, title, or interest the Buyer may have acquired and the items shall revert and repossess back to the Seller without further notice to Buyer. There will be no refund on abandoned items. Auctioneer shall also be entitled to any costs associated with the removal, storage and reselling of Buyer's items, and any other charges, fees, and expenses incurred as a result of Buyer's failure to remove the items including all attorney fees and costs incurred by Auctioneer to enforce Buyer's obligations hereunder. 9. Buyer's online premium for this sale is 15%. 10. Most of these items were purchased by the Seller wholesale with the intent to resale. Under Tennessee Law the Seller must collect sales tax in the amount of 9.75% for the State of Tennessee, Jefferson County. If you are a tax-exempt Buyer, then it is the Buyers responsibility to provide to the auction company a copy of your Sales and Use Exemption form in order to have the sales tax waived. 11. Any declined credit card payment will have two (2) business days to contact the office at 865-397-4214 and pay with a valid credit card. If payment has not be successfully received with two (2) business days you will be reported to HiBid and you may no longer be allowed to bid online at future auctions. Items not paid for will be repossessed by the Seller. 12. All items must be picked up onsite unless other arrangements have been made in advance with the auction company. Jackson Real Estate and Auction does not provide any in house shipping. 13. If the Buyer is interested in having their items shipped, they must make all arrangements with the shipping company of their choice. Buyer is responsible for all cost associated with the shipping of the Buyers items. Jackson Real Estate & Auction shall charge the Buyer a $25.00 handling fee if shipping is involved. This fee can be paid by credit card after the auction if needed. 14. There is a local shipping company near the auction site. Online Only Auction beginning January 31, 2020 at 12 PM EST and will begin to close, soft close, on February 16, 2020 at 2 PM EST. Over 500 plus lots will be sold. Polaris, ATV, UTV and lawnmower parts will all be offered for sale online only. The majority of these items are new and many are still in original boxes and packaging. Selling for Rick and Beverly Watson who operated a Polaris dealership. Many of these parts are hard to find parts that can only be purchased here.
