Auction Terms & Conditions Any online buyer who chooses shipping with purchases over $1000 will be required to send a wire transfer. Wire transfer information will be provided to winning bidders. Thank you for participating in a Midway Auction Company Auction. It is important that you become familiar with the terms and conditions as all sales are final. The terms of sale are non-negotiable. Your credit card will be charged for your purchases immediately following the auction. The online buyer's premium is 15% Sales tax will be collected on all items at the rate of 7% unless we have a current 2023 ST105 on file. It is the buyer's responsibility if shipping to send us a current FFL dealers license for shipping. Midway Auction will not call FFL Dealers. That is the responsibility of the buyers. After the auction all buyers will receive an email via Shipping Saint to choose either pick up or shipping. After your package is ready to be sent you will receive another email to confirm your address and pay for the shipping. After you pay, we will get it out within the next 24 - 48 hours. The cost for shipping is the actual cost of shipping and insurance plus a handling fee of $3 - $10 + time. If you buy a lot of items or items that are time consuming to pack your handling fee may exceed $10 but most packages it will not. The handling is figured on the entire invoice not per lot. PLEASE KEEP IN MIND WHEN PURCHASING AMMUNITION THAT IT IS HEAVY AND THAT THE SHIPPING & HANDLING MAY EXCEED THE PURCHASE PRICE. ALL AMMO OR POWDER BEING SENT TO CALIFORNIA OR NEW YORK MUST BE TRANSFERRED TO A DEALER IN THOSE STATES. Neither the Auctioneer nor the Consigners shall be responsible for the correct description, authenticity, genuineness of, or defect in any lot, and make no warranty in connection therewith. No allowance will be made, or sale set aside on account of incorrectness, error in cataloging, condition or any imperfection. Registration at the auction (online and/or in person) finalizes each bidder's agreement to the terms and conditions of sale as stated in the Contract and any Addenda which are incorporated by reference into your bidding. There is no fee to register although a valid credit card will be required to verify identity and funds. By bidding you are representing to Midway Auction Company (Auctioneer) and the seller that you have read and agree to be bound by the terms and conditions for this sale as stated herein. If you do not agree with any of the terms and conditions stated DO NOT BID or you will be bound by those terms and conditions. By bidding you agree to all disclosures. Buyers are responsible for knowing the rules and regulations of the state in which they live pertaining to the ownership of firearms. ALL SALES ARE FINAL!! If a firearm is purchased and cannot be shipped to the buyer's state the buyer is still responsible for payment of said firearm and the firearm will be sold at our next scheduled firearms auction. THE SALE WILL BE CONTROLLED BY THE AUCTIONEER PROGRAM. Midway Auction Company is not responsible for malfunctions or system errors which cause a bid or bidder to fail to be recognized or registered. According to Indiana state law there are no "tie bids" all "tie bids" will be awarded to the bidder in attendance. All items will be sold 'AS IS, WHERE IS' with no financing, inspection or other contingencies to sale. Midway Auction Company represents the Sellers only and does not inspect properties on bidder's behalf. Buyers must conduct their own due diligence and investigation of each property and must also investigate the suitability of each parcel prior to making a bid and purchase at the auction. Buyers must rely solely upon their own investigation and not any information provided by the Seller or Auctioneer. Failure of a Buyer to be fully informed on the condition of a property will not constitute grounds for any claim adjustment or right to cancel sale. All out of state sales will be shipped to an FFL licensee. All FFL Buyers please bring a copy of current license. All non-FFL purchasers must pass NICS background check screening. All purchasers of firearms must present valid government issued photo identification; the government allows no exceptions. Photo ID must have physical street address; P.O. boxes are not an acceptable form of identification. Purchasers must be at least 18 years old to purchase long guns and long gun ammunition, and 21 years old to purchase hand guns and hand gun ammunition. THERE ARE NO REFUNDS OR BID CANCELLATIONS. THE REGISTERED BIDDER IS PERSONALLY RESPONSIBLE, LEGALLY AND FINANCIALLY FOR ALL AUCTION ITEMS BID UPON WHETHER REPRESENTING ONE'S SELF OR ACTING AS AN AGENT. AN ONLINE BID ACCEPTED AT PUBLIC AUCTION IS A LEGAL AND BINDING CONTRACT TO PURCHASE. Sales tax on all items will be charged at a rate of 7.00%. Internet buyers will be charged for entire packaging and shipping costs. Everything is sold 'as is' and all sales are final. Bidder hereby waives their right to initiate a charge-back on his/her credit card for any reason. Auctioneer reserves the right to charge your credit card at the drop of the hammer. Your invoice will be billed to your credit card following the auction. Any bidder who fails to comply with these terms will be subject to collections from an independent company along with any penalties and fees associated with the service. Descriptions and condition reports are based on a visual inspection of the item. We have made no examination of any internal mechanical workings or firing mechanisms. You should have your firearms inspected and serviced by a qualified gunsmith. Midway Auction Company has the right to terminate the auction at any time; withdrawal from sale of any item; to sell at this auction items not listed; to group one of more lots into one or more selling lots or to subdivide into two lots or more selling lots. The auction company also reserves the right to sell all of the items listed in bulk. Payment: a) All payments will be required to be paid for with the credit card on file after auction is complete. b) Sales tax will be charged and collected on all purchases, as required by appropriate state/local laws. Purchaser is responsible for removal of all purchased goods. No abandonment of purchased items is allowed. All abandoned items will be sold for storage and moving fees. g) Purchases may be paid for and removed at any time during the auction as long as the auction is not disrupted by this activity. Loading Equipment: a) Midway Auction Company does not lend, lease, or borrow any equipment, nor deliver sold goods. Buyer is responsible for their own removal of all items. Please bring any packing material and boxes that you may need. Please bring assistance to move heavy items to your vehicle and any tools for dismantling. Item Removal: All items must be removed within 48 hours of the auction closing and/or within the specified date. If items are not removed by this time they will be forfeited and/or sold for storage. No Liability: a) Midway Auction Company assumes no liability for your purchases. The buyer assumes and does agree to indemnify and hold the auction company and seller harmless from any future claim that shall pertain to fitness or use of the asset being purchased. b) Persons attending during exhibition, sale or removal of goods assume all risks of damage or loss to person and property and specifically release and indemnify the Auction Company from liability therefore. Neither the Auction Company nor his principal or seller shall be liable by reason of any defect in or condition of the premises in which the sale is held. Consignors & Bidders: a) All consignors must fill out a contract with Midway Auction Company, sign forms and abide by our terms listed. b) All bidders must register for bidder's numbers using proper ID or proper information. c) No consignor, seller, or agent for seller has the right to bid on their consigned goods. d) Any employee of Midway Auction Company may bid at any auction if they wish to purchase an item. e) All items become the sole responsibility of the purchaser when the auctioneer confirms your bid as the successful winner. We are not responsible for lost or stolen items. f) If there is any dispute between two or more bidders, the auction company or its� auctioneer, may decide the successful bidder. The decision of the auction company, or its� auctioneer, shall be final and absolute. Loss of Bidding Privileges: a) If you have failed to pay for an item, or failed to timely pick-up items, your bidding privileges will be revoked. Your privileges may be restored by paying for the item or repaying for the loss of the revenue due to the items not having been sold and by placing a credit card on permanent file whereby future purchases will automatically be charged. Delinquent Accounts: a) The bidder that has not paid for, or has not removed their items from the auction site, will be subject to the cost of storage, trucking, re-sale, deficiency balances, collection fees, and any legal fees for recouping a loss due to the bidder's negligence. Reserves: a) Any and all items that Midway Auction Company agrees to sell are subject to a reserve as per Indiana State Auction Law. Documents: a) All documents must be completed in full by buyers and sellers. For Example: Death Certificates, Letters of Authority, Creditor Leins, and UCC's when purchasing vehicles, firearms, etc. b) All gun buyers will be required to fill out a 4473 form and pass a background check. Out of state buyers will be required to have any and all guns shipped to an FFL (Federal Firearms License) Dealer. Compliance with the Terms of Sale: a) In default of payment of bills in full within the time announced for this auction the Auction Company in addition to all other remedies allowed by law, may retain all monies received as deposit or otherwise, as liquidated damages. b) Midway Auction Company�s is in complete accordance with Indiana statutes and Indiana Administrative codes, Title 25, Title 812, Department of Revenue Tax Bulletin #20, and Reference IC 6-2-4. Warranties: a) Everything is sold �AS IS/WHERE IS� with no warranties, representation or guarantees expressed, implied or otherwise given. All sales are final. Conditions of Items Sold: a) All information is believed to be accurate, but the auction company shall not be responsible for the correct description, authenticity, genuineness of or defect in any lot, and makes no warranty in connection therewith. No allowance will be made or sale set aside on account of any incorrectness, error in cataloging or any imperfection not noted. No deduction will be allowed on damaged articles as all goods being exposed for public exhibition are sold �as is� and without recourse. Midway Auction Company requires any and all buyers to preview and make your own opinion of conditions. Auctioneers have the right to refuse service or eject any person obstructing the auction process. The record of sale kept by the Auction Company, the audio tape of the auction and the bookkeeper records will be taken as final in the event of any dispute. DESCRIPTIONS OF SERVICE Sebae provides the following services under the Auction Flex & HiBid trademarks: Integrated Web Service (for auctioneers), internet bidding (absentee, online-only, & webcast). You can learn more about these services in the following sections. HIBID INTERNET AUCTION PLATFORM & WEB SERVICE DESCRIPTION Sebae provides the HiBid (formerly Bidopia) Internet Auction Platform & Web Service ("HWS") under the HiBid trademark as a software solution for auctioneers wishing to extend the audience of their live auctions to the internet. The HWS provides various features including internet absentee bidding, internet-only auctions, and webcast auctions. The HWS is able to changes its appearance to coincide with the website that it is powering. Accordingly, the HWS powers the www.hibid.com website as well as numerous Auction Flex customer websites. This ability to change appearance is a feature of the HWS. Much like internet merchant account providers can host a secure web page for a vendor to easily process payments, the HWS hosts certain portions of the auctioneer's website to easily enable advanced features such as internet bidding. INTERNET ABSENTEE BIDDING Internet absentee bidding allows you to place a bid for an item in advance of an auction. This allows you to place bids on lots without actually attending the auction. INTERNET-ONLY AUCTIONS Internet only bidding allows you to place a bid for an item prior to the auction lot closing online. In an internet-only auction there is no live auction. WEBCAST AUCTIONS Webcast auctions allow you to bid in real-time against other bidders or place pre-bids prior to a lot going "live". Lots are sold in accordance with the Auctioneer's terms and conditions which are accessible from each lot's page. It is your responsibility to read and accept the Auctioneer's terms and conditions prior to placing your bid. When you place a bid you are agreeing to be bound by the Auctioneer's & Sebae's terms and conditions. By placing a bid you are entering into a legally binding and enforceable contract. Sebae does not evaluate Lots and does not act as a specialist or expert on any related subject matter. Sebae makes no warranties or representation of any kind or nature with respect to Lots (including but not limited to representations or warranties as to the accuracy of description, genuineness, quality, authorship, attribution, provenance, period, culture, source, origin or safety). BIDDING The Service requires you to login with your username and password prior to placing a bid on a Lot. Making bids with false information or with stolen credit card information is prohibited and illegal. Your user name and password are required in order to place internet bids. Making bids in a false name or with an invalid or stolen credit card is prohibited. Each bid carries the computer coding of the Internet provider which allows the individual user to be traced and Sebae may at its discretion release this information to enable legal action to be taken. Sebae may, in its entire discretion, refuse or remove bids where it suspects that bids contravene this prohibition. By placing a bid, you are making a binding and irrevocable offer to purchase the Item at any price up to the maximum bid amount you submit. If you win, you must complete the transaction, subject to any contractual right or other right at law to rescind the contract in certain circumstances. Failure to complete transaction without lawful reason is not only a breach of your contract with the Seller but also a breach of this User Agreement. The amount bid can be increased but cannot be decreased. The auctioneer may, at their discretion, allow you to withdraw and resubmit a bid in the case of bids containing an obvious typographical error. You may forward a request to withdraw a bid and resubmit a correct bid by immediately sending an email to the auctioneer, however, there is no guarantee that any bid will be withdrawn. Although Sebae will use best efforts to forward all bids, Sebae does not accept any responsibility for lost bids or problems with the recipient auctioneer's ability to process your bid. Moreover, Sebae cannot guarantee that bids received will be processed by the individual auctioneers. THE WINNING BID The winning bid in an auction will be the highest bid that exceeds any reserve (if a reserve exists). In the case of equal bids, the earliest bid received will be the winning bid. If a higher bid is subsequently withdrawn or removed then the auctioneer shall have the right to accept the next highest bid. NOTICE OF END OF SALE, PAYMENT & SHIPPING After the sale has ended, the auctioneer will notify the winning bidder via phone, fax or mail that they have won. If you do not receive notice that you have made the winning bid and think that you are the top bidder, you should check with the auctioneer directly. You will make all payment for Items to the auctioneer in accordance with their terms and conditions. BUYER'S PREMIUM, TAXES AND DUTIES If you are a successful bidder, you are responsible for paying any buyer's premium, taxes and duties (including any VAT, sales tax and import duties) that may be imposed on the final price paid for an Item. Accordingly, it is your responsibility to check the applicable taxes and duties that may be imposed on an Item prior to bidding for it. PRIVACY We do not sell or rent your personal information to third parties for their marketing purposes without your explicit consent and we only use your information as described in the Privacy Policy. COPYRIGHT All material and content as provided by the Service is protected by copyright and similar rights. You can not use or make available any of that material for any commercial purpose. SPECIAL ADMONITIONS FOR INTERNATIONAL USE Recognizing the global nature of the Internet, you agree to comply with all local rules regarding online conduct and acceptable content. Specifically, you agree to comply with all applicable laws regarding the transmission of technical data exported from the United States or the country in which you reside. DISCLAIMER OF WARRANTIES You expressly understand and agree that: a. Your use of the service is at your sole risk. The service is provided on an "as is" and "as available" basis. Sebae expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement. b. Sebae makes no warranty that (i) the service will meet your requirements, (ii) the service will be uninterrupted, timely, secure, or error-free, (iii) the results that may be obtained from the use of the service will be accurate or reliable, (iv) the quality of any products, services, information, or other material purchased or obtained by you through the service will meet your expectations, and (v) any errors in the software will be corrected. c. LIMITATION OF LIABILITY You expressly understand and agree that Sebae shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if Sebae has been advised of the possibility of such damages), resulting from: (i) the use or the inability to use the service; (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the service; (iii) unauthorized access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the service; or (v) any other matter relating to the service. You and Sebae agree to submit to the personal and exclusive jurisdiction of the courts located within the county of Marion, Florida.
