Auction Terms & Conditions: TERMS & CONDITIONS BY PLACING A BID, BIDDER CERTIFIES THAT THEY HAVE READ AND WILL ABIDE BY ALL TERMS AND CONDITIONS AS STATED BELOW. IT IS THE BUYERS RESPONSIBILITY TO UNDERSTAND ALL THE TERMS AND CONDITIONS PRIOR TO BIDDING. All items are sold "AS IS WHERE IS" with no warranty or guarantees, expressed or implied, by the seller or Schmauss Auction. Bidders accept all auction/property "WITH ALL FAULTS", whether immediately apparent or not. It is strongly recommended that bidders thoroughly inspect items before placing a bid. Items are described as accurately as possible but do not represent any guarantee by the seller or Schmauss Auction. By placing a bid, bidder signifies that they have inspected the item to their satisfaction. By placing a bid, the bidder is entering into a contractual agreement to purchase the item(s) from the seller. Failure to follow through with payment and pickup of items could result in legal collection proceedings. Reserved Bidding Items on auction may have an undisclosed reserve. Sellers, Schmauss Auction, or other agent of seller may bid on items up to reserve amount in order to aid in the sale of the item. *By placing a bid, bidder signifies that they have inspected items to their satisfaction. *Schmauss Auction reserves the right to remove any property prior to close of the auction. *Schmauss Auction reserves the right to reject any bid at our discretion. *Bidders who register at any of our auctions will be included in our mailing list to receive print or digital communication regarding upcoming auctions. Your information will not be sold to third parties, and you may opt out of receiving notices at any time. Pictures and Item Descriptions will be included in item descriptions whenever possible; however, photos may or may not fully represent the item. Lighting, surroundings and other factors can affect the perception of an item in a photo; therefore, all bidders are responsible for their own personal inspection of the item(s) before placing a bid. Photos and descriptions are to be used as a guideline only. Odometer, Mileage & Hour Meter readings are assumed to be correct. These assumptions do not constitute a guarantee. It is up to the bidder to validate the accuracy of the reading during the inspection process. Schmauss Auction is not liable for any inaccuracies pertaining to odometer, mileage and hour meter readings. Auction Software for Schmauss Auction will not be held liable for any software or software malfunction discrepancies and/or internet or WiFi interruptions that could cause a delay in bidding. An invoice and payment instructions will be sent to each buyer's registered email at the close of the auction. Please read the email message completely for payment instructions. Please contact us at 515-571-2443 if you do not receive an invoice from us within 24 hours of auction close. Payment Successful bidders must contact Schmauss Auction within 24 hours after receiving their invoice to confirm their method of payment. Payment must be received within 48 hrs after the conclusion of the auction. If payment is not received or payment arrangements made within 48 hours after the conclusion of the auction, the buyer will lose all rights, title and interest to the item(s), including any and all moneys. Auction items will not be released for pickup until payment is made in full. Failure to comply with these terms will prohibit bidders from participating in future live or online auctions conducted by Schmauss Auction. Item Pickup, Removal and/or transportation of item(s) won on auction shall be at the expense, liability and risk of the buyer. Any Items not removed within 3 weeks of the conclusion of the auction, unless arrangements have been made and agreed upon by the seller, will be considered abandoned and the purchaser will lose all rights, title and interest to the property, including any and all moneys from the buyer. Returned Check Fees A fee of $50.00 will be assessed on returned checks and may result in the bidder being denied access to future auctions. Be sure you are capable of paying immediately after the conclusion of the auction and realize your bids are not conditional upon financing. Payment Procedures Payments will be made to Schmauss Auction. Forms of Payment: -Company/Personal Check -Cash -Credit Card (with a 5% convenience fee for use of a credit card). All purchases under $1000.00 will be automatically charged to your credit card. All Checks are to be made payable to Schmauss Auction. Mail Checks to 305 N Alice St. Woolstock IA 50599 *Please include your bidder number in the memo line. If paying by credit card, for amounts larger than $1001.00 please call our number at 515-571-2443 with your credit card information. We accept all major credit cards. There is a 5% convenience fee per transaction for all credit card purchases. Titles will be sent via standard mail 7 days after payment has been received, unless otherwise specified in the description of the item, and will be mailed to the address provided by bidder upon registration.
