To register for bidding, please read the rules below and click accept at the bottom or top of the page. Please note that by filling out the registration form you are accepting all the terms listed below. Registration- Bidders will register with their account for each individual auction. The approval process requires a valid email address, mailing address, and credit card. Bidders without a valid credit card will not be approved for an account with Home to Home Auctions LLC. Online Bidding- All auctions will have an official closing time, and no further bids will be accepted after that time. The times will be displayed on each individual auction page. All bids without a reserve will be sold to the highest bidder. Please see below for more information on reserves. Home to Home Auctions LLC reserves the right to refuse any or all bids on a case-by-case basis. Home to Home Auctions LLC record of final sale shall be conclusive. Minimum Bids- Each and every lot within the auction will have a minimum bid designated on each lot. If you choose to bid on a lot, you are agreeing to bid the minimum amount designated. Buyers Premium- A 13% buyer's premium will be added to all winning bids. For example, the winner of a lot selling for a high bid of $100 will be billed $113 plus sales tax and shipping/handling charges if applicable. If you pay by Cash, there is a 3% discount. Maximum Bids (Max Bids)- Bidders may place a Maximum Bid, which is the highest amount they are willing to potentially bid on an item. When placing such a bid you are instructing the auction house to competitively bid on your behalf up to (but not over) a given limit. These Maximum Bids must follow the standard bidding increments, listed above. Maximum Bids are kept in strict confidence. Item Information- All descriptions of lots are written to the best of the Home to Home Auctions LLC ability. The history of each item may or may not be known by the Home to Home Auctions LLC, and any information known will be shared in the description, but we cannot guarantee accuracy if we do not have authentication paperwork. Any flaws will be shared in the description and in photographs to the best of the Home to Home Auctions LLC ability, but we cannot guarantee that we will have identified all flaws. Definitions- All items are sold AS IS. If the listing declares that the item "works," this describes the functionality of this item. For example- a cassette player that has been tested with a tape and headphones will be listed as "works" if music/sound plays through the headphones. A cassette player that has been tested with a tape and headphones will be listed as "turns on" if no music plays but the motor begins running when turned on. Not all items will be able to be fully tested to determine new or like-new quality, but the auctioneer will state if the item turns on or works. Payment- Home to Home Auctions LLC accepts credit cards, debit cards, Venmo, certified check, and exact cash in person as forms of payment. Invoices will be sent to all winning bidders within 1 business after the auction by the email provided during account registration. Invoices are payable upon receipt with payment due before items leave the premises. Non-Payment- Any bidder who has not paid in full without having made prior arrangements for late payment will have future bidding privileges revoked. If the bidder prefers to pay cash on pickup but neglects to make their pick up appointment and pay for their items in person, their credit card will be automatically charged for the total amount on their invoice. If you are unable to pick up during your pickup appointment, you may send someone else to pick up on your behalf. Your substitute must provide your invoice number in order to retrieve your items. Failure to Pick Up- If you fail to pick up your items during the scheduled pick up time and have not commuicated with us, you will be charged a $10 fee per invoice, and your item will be shipped if possible. Home to Home Auctions LLC will not provide a refund in the event of Failure to Pick Up. Unless special arrangements are made with Home to Home Auctions LLC, for any items not paid for and/or picked up by the winning bidder within SEVEN (7) days of the date payment was due, the property shall be considered abandoned and any interest the winning bidder may have in the property shall revert back to the seller or auctioneer, and there shall be no refunds to the winning bidder. Additionally, failure to pay for or pick up your items may result in the loss of future bidding opportunities. If a bidder is allowed to bid again, they must first pay their previous incurred charges to be re-approved. These terms still apply to any winning bidders who ask us to donate items for them. The entire lot must be retrieved, and any intentionally neglected items will be subject to the "Failure to Pick Up" $10 fee. This is due to the auctioneer reassuming responsibility for processing or disposing of a purchased item. Pick up- After bidding closes, an email will be sent requiring the winning bidder to select a pickup window. All pickup hours will be posted on each auction, but winners must schedule within those hours. Any pickup requests outside these hours will need to be requested by email (hometohomeauctions@gmail.com) before pickup hours begin. We may not be able to accommodate your request, but we will do our best! Shipping- Items are defaulted for Local Pickup Only, shipping available by Home to Home Auctions, or Shipping with Fragile Pack Only. Customers may choose Home to Home Auctions LLC shipping OR Fragile Pack Shipping (3rd Party Shipper). Procedures for both are outlined below. Special shipping requests should be made to hometohomeauctions@gmail.com. Home to Home Auctions LLC Shipping- There will be a $5 handling fee for all orders shipped by Home to Home Auctions LLC. This applies to each order, not each lot. Home to Home Auctions LLC will choose either USPS or UPS shipping. We will always default to the cheapest shipping option, so any special requests should be made as soon as possible. Customers who need items shipped must pay original invoice balance AND shipping invoice by credit card prior to shipment. NO lots will be shipped until full payment is received. Items will be shipped within two business days. PLEASE NOTE: All invoices greater than $1,000.00 MUST be shipped to a physical address with an adult signature requirement for insurance purposes. We will make every effort to ensure that items are packed and shipped as carefully as possible. We will not be responsible for any damage during shipping, and no refunds will be given. Claims should be made directly with the shipper. Fragile Pack Shipping- Home to Home Auctions LLC invoice is required to be paid in full before we transport your items to Fragile Pack. Fragile Pack will contact the customer directly for payment for their services. Once Home to Home Auctions LLC delivers purchased items to Fragile Pack, no refunds will be given and items will be handled under the care of Fragile Pack, as per their service agreement. Simply put, once Home to Home Auctions LLC drops off your items at Fragile Pack, Home to Home Auctions LLC is no longer involved in any further transactions regarding this order. The emphasis, therefore, is on the bidder to review all photographs and descriptions thoroughly BEFORE placing a bid. Acceptance of Terms- Placing a bid constitutes acceptance of the above terms, and guarantee of payment by the bidder in the amount of their winning bid plus buyer's premium, sales tax, any convenience fees incurred as outlined above, and any shipping fees. Home to Home Auctions LLC reserves the right to reject any and all bids from any bidder. LAWS These Terms of Service shall be governed by and construed in accordance with the laws of the State of Kentucky. User and Home to Home Auctions LLC agree to submit to the exclusive jurisdiction of the courts of the State of Kentucky. If any provision(s) of these Terms of Service is held by a court of competent jurisdiction to be contrary to law, then such provision(s) shall be construed, as nearly as possible, to reflect the intentions of the parties with the other provisions remaining in full force and effect. Home to Home Auctions LLC's failure to exercise or enforce any rights or provisions of these Terms of Service shall not constitute a waiver of such right or provision unless acknowledged and agreed to by Home to Home Auctions LLC in writing. User and Home to Home Auctions LLC agree that any cause of action arising out of or related to this Service must commence within one (1) year after the cause of action arose; otherwise, such cause of action is permanently barred. The section titles in these Terms of Service are provided for reference purposes only and have no legal or contractual significance. DESCRIPTION OF SERVICE Registered bidders agree to provide certain current, complete, and accurate information about themselves and to maintain and update this information as required to keep it current, complete and accurate. All information requested on original sign up shall be referred to as registration data ("Registration Data"). Furthermore, user grants Home to Home Auctions LLC the right to disclose to third parties certain Registration Data about User and Service membership in the aggregate; however, such disclosures will exclude user's name, mailing address, email address, account and phone number, unless: (1) User expressly directs Home to Home Auctions LLC to disclose such information, or (2) Home to Home Auctions LLC is required to disclose such information by any applicable law or legal process served on Home to Home Auctions LLC. MODIFICATIONS TO TERMS OF SERVICE Home to Home Auctions LLC may change these Terms of Service from time to time. For each new auction, users will be required to accept these Terms of Service upon registering for each auction, even if they have changed from the previous auction. User's continued use of the Service constitutes both: (1) their acknowledgment of these Terms of Service and any modifications; and (2) User's agreement to abide and be bound by these Terms of Service and modifications. MODIFICATIONS TO SERVICE Home to Home Auctions LLC reserves the right to remove lots in any auction with or without notice to user. USER ELIGIBILITY Our services are available exclusively to individuals able to form legally binding contracts under applicable law. Without limiting the foregoing, our services are not available to minors. Furthermore, Home to Home Auctions LLC reserves the right to refuse service to anyone for any reason whatsoever. REGISTRATION & ACCOUNT SECURITY Users agree to provide true and accurate information about themselves in the registration form. If any information provided by user is incomplete or inaccurate, Home to Home Auctions LLC retains the right to terminate user's membership and rights to use the Service. As part of their registration, users will receive a User ID and Password. Users are encouraged to keep their User ID and Passwords private because the foregoing data is the only information needed for purchasing power. Users are responsible for the confidentiality of their User ID and Password as well as for any and all activities that occur under their user ID and password-protected account. User agrees to immediately notify Home to Home Auctions LLC of any unauthorized use of their User ID or Password or any other breach of security known to the user. USER CONDUCT User is solely responsible for the contents of his or her transmissions through the Service. Use of the Service is subject to all applicable local, state, national and international laws and regulations. Attempts to gain unauthorized access to other computer systems are prohibited. Home to Home Auctions LLC may, at its sole discretion, immediately terminate Service should the user's conduct fail to conform to these Terms of Service and User Agreement. OTHER LIMITATIONS Home to Home Auctions LLC retains the right, at our sole discretion, to determine whether or not a user's conduct is consistent with the letter and spirit of this Agreement. Home to Home Auctions LLC reserves the right to terminate service if a user's conduct is found to be inconsistent with these Terms of Service and User Agreement. BIDDING AND BUYING Home to Home Auctions LLC Company has the right to establish general practices and limits concerning users' bidding privileges and procedures. A user who has entered the highest accepted bid at the end of an auction is obligated to complete the transaction. Once entered, bids are NOT retractable. Home to Home Auctions LLC and its host are not responsible for bids not being processed or not being accepted due to technical difficulties. Moreover, bid manipulation of any kind is expressly forbidden. A seller is prohibited from placing bids or arranging to have bids placed on behalf of seller, seller's agent or assigns. No shill bidding is allowed. Bidders are prohibited from communicating with each other with the purpose of manipulating the final purchase price of an item. Please note that it is a violation of law to make bids in a false name or with an invalid payment method, even if our software initially accepts such a bid. Be aware that even if you do not give us your real name, your web browser transmits a unique Internet address to us, which can be used by law enforcement officials to identify you. Do not test our auctions with false bids. This puts you at substantial personal legal risk. Fraudulent bidders will be prosecuted to the fullest extent of the law. Currently, both the FBI and the US Secret Service are responsible for investigating all Internet fraud cases. ACKNOWLEDGMENT AND ACCEPTANCE OF TERMS OF SERVICE As operated by Home to Home Auctions LLC LLC, this auction service is provided to you under the foregoing Terms of Service and any operating rules or policies that may be published by Home to Home Auctions LLC. The Terms of Service comprise the entire agreement between Member and Home to Home Auctions LLC and supersede all prior agreements between the parties, regarding the subject matter contained herein. By participating in the registration process, you are indicating your agreement to be bound by all of these Terms of Service. DISCLAIMER OF WARRANTIES USER EXPRESSLY AGREES THAT USE OF THE SERVICE IS AT USER'S SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS" AND & "AS AVAILABLE" BASIS. Home to Home Auctions LLC EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. Home to Home Auctions LLC COMPANY MAKES NO WARRANTY THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, OR THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR FREE; NOR DOES Home to Home Auctions LLC COMPANY MAKE ANY WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE OR AS TO THE ACCURACY OR RELIABILITY OF ANY INFORMATION OBTAINED THROUGH THE SERVICE OR THAT DEFECTS IN THE SOFTWARE WILL BE CORRECTED. Home to Home Auctions LLC COMPANY MAKES NO WARRANTY REGARDING ANY GOODS OR SERVICES PURCHASED OR OBTAINED THROUGH THE SERVICE OR ANY TRANSACTIONS ENTERED INTO THROUGH THE SERVICE. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY USER FROM Home to Home Auctions LLC COMPANY OR THROUGH THE SERVICE SHALL CREATE ANY WARRANTY NOT EXPRESSLY MADE HEREIN. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU. LIMITATION OF LIABILITY Home to Home Auctions LLC COMPANY OR ITS HOST SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, RESULTING FROM THE USE OR THE INABILITY TO USE THE SERVICE, OR FOR COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES, OR RESULTING FROM ANY GOODS OR SERVICES PURCHASE OR OBTAINED, OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH THE SERVICE OR RESULTING FROM UNAUTHORIZED ACCESS TO, OR ALTERATION OF MEMBER'S TRANSMISSIONS OR DATA, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, USE, DATA OR OTHER INTANGIBLE, EVEN IF Home to Home Auctions LLC COMPANY OR ITS HOST HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. AUCTIONEER'S REPRESENTATION AND RIGHT TO BID: In accordance with KRS330.220(6)(a), it is hereby disclosed that, with permission from the seller, the auctioneer and any auction staff members have the right to bid. INDEMNIFICATION User agrees to indemnify and hold Home to Home Auctions LLC Company, its parents, subsidiaries, affiliates, officers and employees, and likewise the host, its parents, subsidiaries, affiliates, officers and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of their use of the Service, a breach of this User Agreement, or the infringement by user, or other user of the Service using registered user's computer, of any intellectual property or other right of any person or entity.
