The following announcements supersede any prior or printed statements and will be attached to and become part of the Auction Memorandum and Real Estate Contract.
All terms & conditions are published.
All prospective bidders must register and receive a bid number to bid.
Bryant Auction & Real Estate LLC has entered into a contract with the conservator, to offer for sale (with seller's confirmation) at public auction the following real property.
THE OFFERING
The subject property is a 4 bedrooms, 4 baths home located in a desirable area of 601 Cashua drive, Darlington SC 29532 / as shown on Tax Map number, 164-11-02-076, Records of Darlington County, South Carolina. If the purchaser wishes to have the property surveyed, or a closing plat, this will be at the expense of the purchaser.
This property DOES have public water & sewer.
SELLER WILL BE RESPONSIBLE FOR THE FOLLOWING COST AT CLOSING.
a. General warranty deed with transfer stamps.
b. Pro-rata share of 2025 taxes at closing.
TERMS OF SALE
The above described property shall be offered "AS IS" & subject to Seller's confirmation of the final bid immediately following auction.
An escrow deposit in the amount of $10,000.00 by personal or company check, cashier's check, or certified funds payable to purchaser's escrow agent. Balance will be due and payable on or before thirty (30) days, delivered to the designated closing attorney. Time is of the essence.
BUYER'S PREMIUM
A TEN PERCENT (10 %) BUYER'S PREMIUM WILL BE ADDED TO THE HIGHEST BID FOR THE PROPERTY, TO BE PAID BY THE PURCHASER.
The buyer will select a closing attorney & will notify Bryant Auction & Real Estate LLC within three (3) business days.
NOTE: THIS IS A CASH TRANSACTION; NO PURCHASE SHALL BE CONTINGENT UPON A BUYER OBTAINING FINANCING. IN ADDITION, NO PURCHASE SHALL BE CONTINGENT UPON BUYER CONFERRING OR TRANSFERRING ANOTHER PROPERTY.
TIME IS OF THE ESSENCE IN COMPLETING THIS TRANSACTION.
DEFAULT
In the event a purchaser fails to close and pay his balance when due, this may result in cancellation of the sale and buyer's premium deposit shall be retained by Bryant Auction & Real Estate LLC, Broker & Seller as liquidated damages. The second highest bidder's number will be recorded in the event the property is not closed for any reason. The second highest bidder may be contracted to submit a contract to purchase at the seller's option or the property may be offered "For Sale" on the open market at the discretion of the seller or his/her agents.
If for any reason a buyer fails or refuses to deposit the required funds and execute a purchase agreement immediately after being declared the highest bidder and the sale is confirmed by the seller, the seller reserves the right to declare the bidder's rights forfeited and may resell the property.
CONDITIONS OF SALE
Title to this property will be conveyed by General Warranty Deed, free and clear of any liens or encumbrances. It will be conveyed subject to any existing right-of-way or utility easements, encroachments (if any), zoning, health department regulations, or any federal, state, city, or county laws and ordinances, and any applicable restrictions and covenants as applicable to the property in this area, all a matter of record.
This property is being OFFERED "AS IS, WHERE IS" without any warranty other than title, expressed or implied, including without limitation, any warranty as to condition, habitability, merchantability, operability, or fitness for a particular purpose or use. Any rezoning of subject property will be at the total discretion and expense of the purchaser.
It is assumed all prospective purchasers have exercised due diligence upon inspecting the subject property and are satisfied with the condition of the real estate.
Purchaser agrees that he/she is buying the property as per the aforementioned conditions including, but not limited to environmental conditions of the property and the presence of contamination by hazardous materials or whether the property lies in any flood plain, flood way, or special flood hazard area.
PURCHASER WILL BE RESPONSIBLE FOR THE FOLLOWING COSTS AT CLOSING:
a. His or her own attorney fees.
b. All costs in regards to financing, title insurance, recording fees applicable to this transaction.
c. Pro-rata share of 2025 taxes at closing.
d. Any inspection cost.
e. Any cost for survey if required
