Wasatch Frontier Group LLC, herein referred to as Auctioneer, is conducting auctions on behalf of the property's seller. By placing a bid on auctioneers' online selling site or in person, the Buyer agrees to all terms and conditions stated henceforth or posted onsite or online. Auctioneer reserves its right to revise terms and conditions at any time. TERMS OF SALE: Everything will be sold "as-is, where is, with all faults known or unknown, seen or unseen". There is no warranty offered, expressed, or implied. The Buyer shall rely entirely on their own inspection and information. The bidder is responsible for knowing which item he/she is bidding on. If there is any doubt about the items in any lot, do not bid. Any information provided for the item is done to the best of our knowledge and may not be 100% accurate and thus not responsible for any inaccuracies. Once a Bidder places the winning bid and Auctioneer and HiBid/AuctionFlex software says sold, that Bidder is solely responsible for proper payment of any lot or lots won. Buyer�s Premium: A fee will be charged on all lots sold. 12% on each lot. Some lots may have a lower premium. Check the lot details for the exact premium amount prior to bidding. Some lots will have a reserve price that will need to be met in order to sell the item. The reserve price is not disclosed. HiBid will indicate if the reserve price is not met. The Auctioneer is not to be held liable for any inaccuracies being reported by HiBid relating to the reserve price. Wasatch Frontier Group LLC and its affiliates may bid using one or more bidder numbers to protect reserve pricing pursuant to Utah Code 70A-2-238. If you have any questions about this, please contact us prior to bidding. If Buyer is the winning bidder of a lot or lots, they are expected to pay for the item or items. A winning bid will be treated as a contract, regardless of any unexpected computer or clerical error after that point. The Auctioneer reserves the right to refuse a bid and/or reject bids not in the best interest of the Seller. The Auctioneer reserves the right to remove an item from an auction either live or online at any time and for any reason. Any invoice with a balance still owed after 5 business days following the auction is subject to a penalty fee of $10 per day and the maximum late fees allowed by the state of Utah. Auctioneers or owners make no warranties or guarantees as to genuineness, authenticity of, or defect in any lot and will not be held responsible for advertising discrepancies or inaccuracies. All sales are final when awarded to the successful bidder. The Buyer accepts full responsibility for all purchases made and holds the Auctioneer, owners, and property owners free of any liability in the event of theft or disappearance of any items purchased or consigned. Auctioneer is not responsible for any liability or damages that occur during or after the auction. Payment Options: Visa, MasterCard, Discover, American Express, Wire Transfer, Zelle, ACH, Cashier�s Check, Debit Card, and Cash are accepted. Wire transfers, ACH, and Zelle deposits are free of charge; instructions will be provided via email with your invoice. Debit and credit cards are accepted up to a maximum of $1,999 and will incur a 3% convenience fee. For payments of $2,000 and over, payment must be completed by cash, check, Zelle, or wire transfer. For payments over $5,000, payment must be completed by cash or wire transfer only. International buyers must pay by wire transfer. At the close of the auction, the credit/debit card on file with HiBid will be charged for any winning lots unless the total invoice exceeds $1,999, in which case the Buyer must arrange an acceptable form of payment per the rules above. Any shipping costs will be invoiced separately once a shipping quote is agreed upon by the Buyer. No refunds will be issued, and credit card payments cannot be reversed. All payments are due within five (5) days after the end of the auction, unless otherwise stated. Utah residents will be charged sales tax unless a valid resale certificate is provided prior to the close of the auction. Sales tax applies to the invoice total and the Buyer�s transaction fee. The Buyer also agrees to pay any sales tax that may be assessed after payment has been received. If any online credit card payment is declined or any onsite payment is not made when due, the Auctioneer may, at its discretion, resell the item(s) to another bidder at any time. The Buyer will be banned from future auctions, and the account may be reported to HiBid for nonpayment. Payments must be made when due. BUYER REGISTRATION: There is no fee to register. A $1 credit card authorization will occur to verify credit card information; this is not a payment. You must register for each auction to receive a bidder number. Online registration requires a valid debit/credit card for a payment method. The Buyer�s name is to remain confidential and not disclosed on the auction platform. The Auction company reserves the right to require a cash/credit card deposit if it believes it is in its best interest. The Auction company also reserves the right to refuse or revoke registration at its sole discretion, including if a bidder�s HiBid score is zero (0) or below, or if there are negative remarks from other auctioneers in the bidder�s profile. The Auctioneer may cancel and ban any such bidder without further notice. To bid in an online auction: Click on LOGIN or NEW BIDDER, then CREATE NEW ACCOUNT to get a username & password. Once you are registered and have a Username & Password, you can place bids once a lot opens for online bidding. The bids you place are FINAL and constitute a binding contract between the Bidder and Auctioneer/Seller. Be aware that lots can close at different times and even different days, and may be extended. You are responsible for monitoring these times. Bid early. Bids cannot be retracted and remain binding once placed. The Bidder is accountable for being informed about property and associated costs before bidding. A maximum bid may be placed on the lot and its contents/items, and is kept confidential. The Bidder authorizes the Auctioneer to place bids on the Bidder�s behalf up to the maximum bid amount. Upon the sale of such property, information and the purchase amount may be posted on the HiBid website for a period of time. All questions or disputes must be resolved immediately; no changes or adjustments will be made at a later date. The Auctioneer reserves the right to reopen bidding, and the Auctioneer�s decisions will be final. VEHICLE TITLING: All vehicles listed for sale will have a clear title unless otherwise noted in the listing description. Premier Auctions will clearly indicate any title discrepancies, salvage titles, or other issues in the vehicle�s listing details. It is the Buyer's responsibility to review this information before placing a bid. Titles will be processed in the name registered with the auction, and no open titles will be given. TITLE DELAY NOTICE: In the event a vehicle listing specifies a title delay, the Buyer acknowledges and agrees that there could be a 30-45 day delay in receiving the title. Wasatch Frontier Group will send the title as soon as it is received. Buyers should plan accordingly and bid with this understanding. Any title delay will be clearly noted in the vehicle listing, and we will communicate the status to the Buyer as updates become available. PICKUP / SHIPPING: Shipping services may be offered for some lots. Please check the lot details to verify if shipping is offered prior to bidding. There is a $10 service fee for shipping that is added to your invoice if shipping is requested. This fee covers packaging costs and will not matter based on quantity of items. For vehicles, we prefer that the Buyer pick up the vehicle. We can provide a quote for shipping through a third-party transportation company if requested. Please contact us for a quote prior to the close of the auction. Payment will still need to be completed in the specified time period before any items will be shipped or allowed for pick up. The Buyer is solely responsible for all costs incurred to remove items won. Local or Onsite Bidders must pick up their items won by the following Friday after the end of the auction at 5:00 PM MST. If items are not picked up by the specified time period, storage fees will apply, and after 30 days, items will be deemed abandoned and forfeited to be disposed of or resold per Utah state laws. Storage fees will be charged at the rate of $25 per day for vehicles and $10 for any non-vehicle items. Items not at Wasatch Frontier Group's facility yard, such as offsite business or universities, will have a limited time to remove before forfeited and disposed of. These lots will be specified in the listing description. Please note that with these lots, if you do not pick up within the schedule, you will lose it. We are willing to work with you to make sure this doesn't happen, but communication is very important to make sure we know how to help. The Buyer is responsible for contacting auction representatives and making other arrangements to pick up their items won if they think they will need additional time. We are happy to work with those needing shipping. No items are allowed to leave the auction site until all fees are paid in full. Buyer must present a PAID invoice before items can be removed. LOADING / UNLOADING POLICY: Auctioneer is not responsible for loading or unloading equipment or the securing of any loads. Auctioneer is not responsible for verifying that equipment being transported to/from the auction yard is properly secured or being carried in compliance with applicable transportation laws and regulations. Auctioneer will not load and/or unload self-propelled equipment under any circumstances. RISK OF INJURY: Bidder acknowledges that an auction site is a potentially dangerous place and shall be deemed to be there at his/her own risk. No person shall have any claim against the Auctioneer, owners, their agents, employees, or principals for any injuries sustained or for damages to or loss of property which may occur from any cause whatsoever. Bringing children is not advised and must be monitored by an adult. Wasatch Frontier Group LLC reserves the right to update or amend our "terms and conditions" without prior notice. FIREARMS: All firearm sales are conducted in strict compliance with federal, state, and local laws. Buyers must be at least 18 years old to purchase long guns and 21 years old to purchase handguns or firearm receivers, as required by federal law. Buyers must provide a valid government-issued photo ID and pass a federally mandated background check (NICS) prior to taking possession of any firearm. All firearm transfers must be conducted through a Federal Firearms License (FFL) holder. Buyers purchasing firearms must provide the name and contact information of their preferred FFL for the transfer, as firearms will not be shipped directly to buyers unless the buyer is also an FFL holder. The buyer is responsible for all transfer and shipping fees, and firearms must be shipped in accordance with ATF regulations, including adult signature upon delivery. It is the buyer�s sole responsibility to ensure the purchased firearm complies with all applicable state and local laws. Firearms or firearm-related items may not be shipped to jurisdictions where they are prohibited, including but not limited to California (unless CA-compliant), New York, New Jersey, Massachusetts, Connecticut, Washington D.C., and others. Buyers are advised to verify legality prior to bidding. Magazine capacity restrictions will apply in states with such laws. Buyers in restricted states will receive firearms without high-capacity magazines, and no substitutions or discounts will be provided. All firearms are sold �as-is� with no warranty, expressed or implied, unless otherwise noted in the lot description. Descriptions and photos of firearms are provided to the best of our knowledge, and buyers are encouraged to inspect firearms in person, where applicable, prior to bidding. By placing a bid, buyers affirm they are legally permitted to purchase, own, and possess firearms under federal, state, and local laws. All firearm transfers require completion of ATF Form 4473 and a NICS background check. If a buyer fails the background check or is otherwise prohibited from receiving a firearm, the sale will be canceled, and the item may be resold. The buyer will forfeit their buyer�s premium and may incur additional fees. Active duty law enforcement officers purchasing firearms must provide a valid law enforcement ID and complete any required paperwork. Exemptions to certain state or local restrictions for law enforcement personnel must comply with specific legal requirements and will be verified during the transfer process. No open titles or unregistered firearms will be sold. Machine guns, suppressors, and other NFA-regulated items will only be transferred to buyers who hold the necessary ATF tax stamps and are eligible under the National Firearms Act. All firearm sales are final. Returns will only be considered if there is a material discrepancy between the description and the actual item, at the sole discretion of the auctioneer. Any disputes regarding firearms must be resolved prior to completing the transfer. Once a firearm has been transferred to the buyer, no returns or adjustments will be allowed. Buyers assume all liability for the use, storage, and transportation of firearms purchased in this auction. The auctioneer, Wasatch Frontier Group LLC, and its affiliates are not liable for any misuse of firearms or firearm-related items sold through this auction. 80% LOWER FIREARMS AND COMPONENTS: All items classified as 80% lower receivers are unfinished firearm components requiring additional machining to become functional firearms. Buyers are solely responsible for ensuring compliance with all federal, state, and local laws regarding the purchase, possession, and use of these items. Some states, including but not limited to California, Colorado, Connecticut, Delaware, District of Columbia, Hawaii, Illinois, Maryland, Massachusetts, New Jersey, New York, Oregon, Rhode Island, and Washington, have restrictions or outright bans on the sale, possession, or use of 80% lower receivers. By bidding on these items, buyers affirm they are legally permitted to purchase and possess such items in their jurisdiction. A signed Affidavit of Legal Compliance will be required before the release of any firearm-related items. This affidavit certifies the buyer's adherence to all applicable laws. Wasatch Frontier Group LLC will not be liable for any misuse, non-compliance, or legal consequences arising from the purchase or possession of these items. Please note, we will not ship nor release any 80% lowers to any bidder residing in a state with restrictions on 80% lower receivers. No exceptions to this rule will be allowed. Valid ID showing you are the bidder and from a state that allows 80% lowers will be required. Law enforcement will be exempt on a case-by-case basis due to varying laws by jurisdiction.
