TERMS & CONDITIONS
For purposes of these Terms & Conditions the phrase Buyer / Bidder / similar words all refer to the party bidding at the Auction. This is a legally binding contract in which the Bidder is entering into in order to participate in the Auction hosted by 555 Auctions / the Auction House /or any similar phrases used below. By bidding the Bidder acknowledges that they have read and agree to these Terms & Conditions. The Bidder understands that their acknowledgement is being recorded along with other identifying information.
Condition of Property Sold: Items sold are in various states of condition ranging from new-in-box (NIB) to used, others are antiques and are over 100 years old. All information listed, including the title, description, condition and the photographs should be considered as informational and an opinion, not a declaration of any type of guarantee nor warranty. The Buyer is solely responsible for inspections prior to bidding. There is a live In-Person Auction Preview offered to all Buyers. While multiple photos may be given for the auctioned items, the photos should not be considered a replacement for attending the In-Person Auction Preview before bidding. If the Auction is held on-site and no preview is available, the Bidder agrees that they are satisfied with the items, and agrees to accept the items with any and all defaults and defects which may be present. The Bidder accepts that photos may differ from the actual item due to various conditions such as lighting, color display differences and a myriad of other technology factors Furthermore the Buyer acknowledged they had ample time to research the items and contact the Auction House for any additional information prior to bidding..
All items sell in "as-is, where-is" condition with no guarantees or warranties implied or conveyed.
All sales are final; there are no returns, no refunds and no exchanges.
In no circumstance are Chargebacks allowed (first reference)
Buyers agree that by entering a bid during the auction they have inspected the property, are satisfied with the condition of the property, and are entering into a contract to purchase the property. While all bids are considered, the Owner and/or Auction House has the right to accept or reject all bids, including the high bid.
All accepted bids will have a 15.55% Buyers Premium added to the bid. There are no additional charges for payments via credit card. We collect sales tax at the local rate per the laws of the State of Illinois. For Auctions held within Monroe County the rate is 7.50%. This rate may vary for auctions held at other locations. Note, for most estate lots, coins & currency no tax is collected.
FRAUD PREVENTION MEASURES:
We follow the credit card industry guidelines for fraud prevention
We have access to and use a service that provides enhanced credit fraud monitoring
We have successfully won 96+% of all of our chargeback challenges
We utilize the industries latest AI technology to monitor suspicious credit card activity
We have joined a nationwide legal network who has successfully sued and won monetary damages in all 50 states from people attempting to commit credit card fraud.
Payment: All invoices will automatically be charged to the card on file upon conclusion of the auction. Declined payments will receive an invoice with a paylink. Payments not made in full within 48 hours of the auction closing are subject to the Non Paying Bidders clause below and forfeit all rights and claims to any won lots. For certain items, such as gold, vehicles, or other large purchases the auction house reserves the right to require wire payment, check payment or cash payment.
No Chargebacks: (second reference) Bidders AGREE THAT UNDER NO CIRCUMSTANCES ARE CHARGEBACKS ALLOWED. If the Bidder claims their account has been hacked, illegally used to bid, their identity has been stolen or any other type of fraud they agree not to attempt to stop or reverse payment, including agreeing to no chargebacks until they have submitted the following various legally notarized documents to the Auction House: 1) Police filing specifically mentioning the name and date of the auction where the alleged fraud occurred 2) A court filing showing the Bidder suing the person or entity for Identity Theft or fraud.
Buyer agrees that if they decide to do a chargeback, they will receive a summons to appear at the Monroe County Court House in Waterloo, Illinois. The Buyer agrees to pay all court related fees, the legal fees of the Auction House, to reimburse the Auction House for the entire amount of the chargeback, and an additional amount to compensate the Auction House for lost time and productivity of the greater of $50 or 10% of the amount of the chargeback. The Buyer acknowledges they agreed to NO CHARGEBACKS. (Third reference)
Consent to Pay for All Arbitration Fees: If the Bidder attempts a chargeback, they agree to pay all associated fees including Arbitration Fees, Filing Fees and any other fee including those charged to the Auction House.
Consent to Jurisdiction: Should the Bidder pursue any legal action against the Auction House they agree to all litigation to occur at the Monroe County Court House in Waterloo, Illinois.
Consent to Pay Legal Fees: Should the Bidder pursue any legal action against the Auction House they agree to pay all legal fees, all of the Auction Houses attorney fees and all court filing fees.
Abandoned Items: If no specific arrangements are made with the Auction Firm before bidding, the Buyer agrees that Items not picked up during the In-Person Pick Up or arranged to be shipped are considered abandoned and after 30 days will be resold to cover the various costs such as storage fees, relisting fees, and other fees. Excess proceeds may be donated to the Monroe County Humane Society and the Morrison Talbott Library. The Buyer understands abandoning an item does not negate the Buyer from paying for the item and agrees to no chargebacks for abandoned items.
Non Paying Bidders: Bidding, establishing the high bid, and then not paying creates difficulties for the Auction Firm including delaying payment to sellers, which hurts the Auction Firms reputation, creates additional costs and burdens to the Auction Firm. As such, all Non Paying Bidders will be reported to the auction platform and will be banned from bidding at our future auctions. Being reported may negatively impact your ability to bid on the platform including other auction houses, including being denied the opportunity to bid.
Shipping: The Auction Firm will provide shipping for many items. Shipping will normally occur 3-7 days following the Auction Close. Shipping will be via a major provider such as the U.S. Post Office, FedEx, or UPS. Lots are shipped insured through Shipping Saint. If any lots are lost or damaged during transportation the Buyer agrees to work directly with Shipping Saint to handle all claims, including insurance and reimbursement claims.
Shipping & Handling (S&H) Charges: S&H charges are separate from the Purchase Invoice and do not negate the Buyer from the obligation to pay the Purchase Invoice in full. S&H Charges include handling, materials, insurance and shipping costs. The Buyer will be sent a separate S&H Invoice to be paid prior to Shipping. (Note we will try to ship via the most economical method possible) We regularly post actual costs charged to customers on our website 555Auctions.com so you may research total costs before requesting our in-house shipping service.
Errors, Omissions, Discrepancies (EOD): In the event there is an error in a listed lot the auction house has the right to remove, cancel, or terminate the lot, even after the auction has closed. An example of an error is having photos that do not match the description or accidental duplicate listings being created. EODs benefit no one. We try diligently to avoid them. In the unlikely event an EOD occurs the Buyer agrees that the Auction Firm has sole discretion to the remedy, including determining if any reverse of charges will occur. See Agreed Limited Liability section for value agreements.
Technology Malfunctions and Uncontrollable Events: In the event of a technology malfunction or an uncontrollable event (such as extreme weather, server errors, power outages, etc), the Auction Company may pause lots, delay the close of the lots or remove lots (including lots that have active bids), and in extreme cases stop and restart the auction at a later date. These events, while rare, do happen. Technology malfunctions such as the software platform sending out errant sold notifications are beyond our control and do not constitute a sold event.
Agreed Limited Liability: The buyer agrees that in no circumstance will the value of a lot exceed the accepted high bid at that auction for that lot and that no matter what the perceived value, expected resale value, replacement appraised value, or any other measure of value is it shall not be higher than the accepted high bid at that auction. Accepted high bid does not include artificial high bids, retracted high bids or any other attempt to manipulate the high bid.
Bidder Agrees: The Bidder agrees they have read and understood the Terms and Conditions of this auction and they agree to abide by them. The Bidder agrees to absolutely no chargebacks (Fourth Reference)
