Lil Dusty Online Auction Terms and Conditions “Lil Dusty Online” conducts auctions via Online Webcast and Live Bidding. The auction website may be browsed by the general public at any time. To use auction services all users are required to register by completing the online “User Registration Form.” Registration and Bidding on auction website is free. All registered users must be at least 18 years of age, and in legal form to agree to a binding contract in the United States of America on the day of registration. Users agree to Auction Terms and Conditions upon registration and bidding. Lil Dusty Online Auctions are subject to the following terms and conditions. All bids are considered a legally binding contract with Lil Dusty Online. Once a bid is entered into the website it cannot be canceled or retracted. Users are responsible for their online account, including maintaining confidentiality of their password. Users are responsible for all bidding activities. Lil Dusty Online is not responsible for any loss, damage, or cost associated with unauthorized use of the user account. Lil Dusty Online is a live online bidding platform. Listings will close for bidding in groups, on the minute. Items that receive new bids within 5 minutes of their ending time will receive an extension by 5 minutes. All items listed have a minimum starting price of $2. All final invoices are subject to a 10% buyers’ premium. Users acknowledge that all items are being purchased are in “AS IS, WHERE IS” condition, without relying upon any representations or warranties, express or implied, of any kind. Some items may be available for inspection during our normal business hours. Items are listed with descriptions that users may find inaccurate or lacking in detail. All items are to be inspected by the buyer at the time of pickup. Decision to offer refund or credit due to damage or missing items will be made at that time, though Lil Dusty Online reserves the right to deny refunds for any reason. Any and all refunds or credit due are forfeited 14 days after the closing of the auction. Pickup times are posted in each auction and on the auction main web page. Items won MUST be removed by 12:00 Noon Eastern of the Wednesday following the end of auction. Items not removed by the posted time may result in storage fees, or items may be considered forfeited. This does not change the user’s invoice and all bids must be paid for. Storage charges will be added weekly as followed; 20% of the invoice(s) total, or $5.00, per week, whichever is greater. Thursdays are reserved only for consignor drop off, 9am – 2pm Eastern. All invoices are subject to 6% local sales tax. Tax exemption will be provided to eligible users. Proper and up to date tax exemption documentation is required to be delivered to our office prior to tax exemption status being granted. As of current Terms and Conditions update Lil Dusty Online does not provide in-house shipping. Shipping may be provided on items that can be reasonably shipped, and is up to the discretion of Lil Dusty Online. Buyers are responsible for any and all shipping fees, including additional handling costs. In addition, Lil Dusty Online reserves the right to contract shipping to a third party processor for any reason. Buyer will be notified of all costs and fees, method of shipping, and will be required to pay for costs prior to shipment. ALL shipping requests must be made, in writing, with phone call confirmation to Lil Dusty Online by 2:00pm the Saturday following the end of auction. Payment Terms Lil Dusty Online accepts cash, check, money orders, Visa, and MasterCard. Checks issued from out of state banks will be subject to a 10-day holding period. Checks written with non-sufficient funds will be charged an additional $35.00 fee. The terms and conditions may be changed and updated at any time via our online auction website. This Agreement was last revised on June 10, 2022. It is our customers’ responsibility to stay up to date on our terms and conditions. The laws of the State of Michigan shall govern these provisions.
