TERMS OF SALE: The Real Property will be sold for cash in hand on the date of sale, or under any different, other, or additional sale terms as the Successor Trustee, in his or her reasonable discretion, determines to be appropriate or advisable. The sale shall be further subject to the following: 1. The property will be conveyed in an "AS IS" physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the aforesaid Clerk's office or affecting the subject property. 2. All real estate taxes delinquent, currently due, or hereafter due will be the responsibility of the buyer. 3. The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia CodeĀ§ 11-22-1. 4. The Beneficiary/and or the Servicer of the Deed of Trust and Note reserves the right to submit a bid for the property at sale. 5. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 6. In the event that there are federal tax liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer. 7. The undersigned Successor Trustees expressly reserve the right to reject any and all bids, and the right to adjourn the sale from time to time without notice other than oral proclamation at the time and place appointed for the sale. Such adjournment may be for a period of time deemed expedient by the beneficial owner and shall not be construed to be a waiver of the right to make the sale contemplated by this Notice. 8. The successful bidder will be required to execute a memorandum of sale upon the acceptance of the successful bid by the Successor Trustee. 9. The trustee's sale shall be open to online bidders via Joe R. Pyle Complete Auction & Realty Service. 10. A 10% buyer's premium will be added to the high bid for the Real Property. The high bidder shall pay the buyer's premium to Joe R. Pyle Complete Auction & Realty Service, plus an additional 10% of its bid on the day of the sale (the "Good Faith Deposit"), with the balance to be paid in cash at closing within 30 days after the date of sale. Example: A purchase price of $100,000 would require both a $10,000 buyer's premium payable to Joe R. Pyle plus an additional $10,0000 down payment payable to Mary L. Robinson, Substitute Trustee, or a designated agent, on the date of sale, for a total of $20,000 due on the day of sale. 11. Additional terms of sale may be announced prior to the sale.
