By bidding or/and tendering payment for the product you agree to these terms and conditions. A) TRISTAR CITY LLC AGREEMENT: *By registering to bid for this auction either in-house or online and/or placing a bid in this auction the BIDDER/BUYER agrees to all the terms and conditions stated and by doing so constitutes a binding contract between Tristar City LLC and the bidder/buyer. When bidding on any lot offered by Tristar City LLC, the bidder indicates acceptance of the following Terms of Sale. Any participation in the auction binds you to agreement of these terms whether or not you read or understand said terms. The Terms in writing contained herein are subject to change without notice and bidder agrees that the most recently published Terms of Sale as published or amended on the website at the beginning of the auction shall apply. *Tristar City LLC makes every effort to accurately describe all items offered in its sales. All items are sold as is, where is, with all faults. There are no warranties or representations of merchantability, of fitness, nor of any other kind, express or implied. All items are available for your examination prior to bidding. Your bidding will signify that you have examined the items as fully as you desire, or that you have chosen not to examine them. Written and oral descriptions are our opinions and should in no way be construed as a guarantee of any kind as to age, condition, materials or any other feature of items being sold. Our goal is to provide prospective bidders with accurate and detailed information. We recommend prospective bidders examine all items in which they have an interest. If you require absolute certainty in all areas of authenticity, and the results of your evaluation leave uncertainty in your mind, we recommend you not bid on the item in question. We do not give refunds. All sales are final. No statement written or oral made by the auctioneer shall be deemed a warranty or assumption of liability by Tristar City LLC or by any seller represented by Tristar City LLC. *Auctioneer reserves the right to reject any bids that are deemed inappropriate or withdraw any item before or during the sale.*Auctioneer may facilitate the employment of carriers and packers as a convenience to purchasers, but assumes no responsibility for their actions.*Buyer hereby agrees that any suit, action or legal proceeding arising out of or relating to the auction shall be brought solely and exclusively in the courts of the State of Illinois in and for Cook County. Buyer further waives the right of jury trial, considering arbitration and reasonable means of reconciliation foremost. *Your registration at the auction guarantees that you have read and will abide by the terms and conditions. B) TERMS: * All items sold "AS IS, WHERE IS" with all faults. We Do Not have a return policy. Be sure you are comfortable with your bidding before you place your bids. * All descriptions believed accurate but not warrantied. * Bidder inspection is encouraged. If you choose not to personally inspect each item of interest to you, the bidder, our decision about the quality & description, will be final. Remember there are no returns. If you are local and would like to inspect these Auction Lots in Person, I will try to ablidge everyone. * JEWELRY: Strung jewelry is usually antique or vintage and may need restringing. Some colored gemstones may have been treated to improve their appearance through methods such as heating and/or various clarity enhancements. These methods are considered common by the international jewelry trade but may require special care of the stone over time. We do not obtain a gemological report for every gemstone sold in our auctions. When we do receive gemological reports, they are described or photographed in the catalogue. Gemstones are not removed from mounts or settings unless stated in reports. Assume all jewelry information is approximate or send a third-party to inspect and verify when a report is unavailable. Estate jewelry may need cleaning. COINS AND CURRENCY: LISTED IN TRISTAR CITY'S CATALOG AS GRADED AND ENCAPSULATED BY PCGS, NGC, ANACS, ICG, PCGS CURRENCY, PMG, PCGS BANKNOTE GRADING, CMC OR ANY OTHER THIRD-PARTY GRADING SERVICE ARE LIKEWISE SOLD "AS-IS" EXCEPT AS EXPRESSLY SET FORTH HEREIN. No material certified by third-parties may be returned to Tristar City LLC, because of a possible difference of opinion with respect to the grade offered by such third-party organization, dealer, or service. No guarantee of grade is offered for uncertified lots sold and then subsequently submitted to a third-party grading service. ALL THIRD-PARTY GRADING SERVICE GUARANTEES, INCLUDING AUTHENTICITY, ARE THE SOLE RESPONSIBILITY OF THE THIRD-PARTY GRADING SERVICE AND NOT WARRANTIES OR GUARANTEES OF TRISTAR CITY LLC. BIDDERS SHOULD CONTACT THESE THIRD-PARTY GRADING SERVICES DIRECTLY WITH RESPECT TO ANY CLAIMS OR QUESTIONS THEY MAY HAVE CONCERNING THEIR GUARANTEES AND WARRANTIES. There are absolutely no exceptions to this policy. Notes sold referencing a third-party grading service are sold AS IS without any express or implied warranty. Grading, condition or other attributes of any lot may have a material effect on its value, and the opinion of others, including third-party grading services may differ with that of Tristar City LLC. Tristar City LLC shall not be bound by any prior or subsequent opinion, determination, or certification by any grading service. Bidder specifically waives any claim to right of return of any item because of the opinion, determination, or certification, or lack thereof, by any grading services. Third-party graded notes are not returnable for any reason whatsoever. WATCHES AND CLOCKS: Almost all clocks and watches are repaired in their lifetime and may include parts that are not original. We do not warranty any individual component as authentic. Watchbands may not part of the original watch and may not be authentic. Clocks may be sold without pendulums, weights, or keys. We do not give warranty that any watch or clock is in good working order. Certificates are not available unless described in the catalogue. Wristwatches may have been opened to find out the type and quality of movement. Water-resistant cases may not be waterproof. ART AND OTHER ITEMS: Tristar Coty LLC is familiar with repair and certain types of restoration; however, we are not restorers or conservators. If information beyond the scope of our provided condition or your requested condition report is needed, we suggest you contact a reputable appraiser, restorer, or conservator prior to bidding. Antique and vintage gilding and craquelure to canvas will require careful handling by your shipper. OTHER: Assume electrified items and lighting have been repaired at some point, missing parts, or need to be serviced. Wiring is not guaranteed, ever. Textiles, upholstery, and rugs may need cleaning. Writing instruments may not contain ink or write. Assume finish terms such as silver, bronze, gold, copper, etc., relate to finish and not actual material unless stated or specified in grams or with a troy ounce or karat weight. All weights are approximate and provided as a courtesy. We are not obligated to accept any item on consignment to resell in a future auction. It is recommended you view items in person or contact a specialist prior to bidding if any hesitation as to condition, age, color, odor, tarnish, dust, stains, size, origin, or nature of any item. By bidding, you signify that you have either closely examined the items, have chosen not to examine them, or have hired an independent agent to examine the items for you. Condition and descriptions in each auction lot entry are based on opinion and are provided for guidance only, without legal obligation. Photos are provided as an additional proof source of condition. Please view ALL detailed pictures prior to requesting additional condition reports. Images also constitute online condition report. Please use the messaging feature with additional requests. Items sold AS IS, WHERE IS. NOTE: Condition reports, photos and video or digital images are provided as a courtesy and should not be used as a substitute for inspecting the items in person. All items are sold as is in accordance with the Terms of Sale. If a paper catalog is printed prior to auction, all descriptions and photos posted online supersede any printed catalog information, including dimensions, piece count, areas of repair or damage shown in photos. We reserve the right to update lot information at any point prior to the fall of the hammer in the description or by live, online announcement via the sales platform. Buyer should solely rely on updated information posted online the day of auction. Use caution when entering an auction! Please understand you have a responsibility to pay and remove items in a timely manner. If you are unable to do so, we recommend you enlist the help of an agent to handle on your behalf. Your bid is your commitment to the full terms listed herein. Any departure from these terms could result in a permanent dispute on your record and removal from bidding platforms. * By placing a bid, bidders signifies that they have examined the items to their satisfaction or that they have chosen not to personally examine them. * The bidder assumes full responsibility for items at the fall of the hammer (or expiration of time in an online auction). A bid entered by mistake on the part of a bidder is NOT grounds for a cancellation of the bid. Each bidder is responsible for his or her own account and bids. By allowing access to another who enters a bid without your knowledge will NOT be grounds for a rescission of the bid(s). Therefore, any bid made on your account will bind you to the bid in accordance with these terms. If an entity places a bid on a lot, then the person executing such bid on behalf of the entity hereby agrees to personally guarantee payment for any successful bid. * We reserve the right to reject any bid at our sole discretion. *REGISTRATION / BIDDER REQUIREMENTS: Bidder will register for an auction in person with a valid government identification card that has a photo of the bidder or with a valid credit card that will be billed for online bidders to verify identity. Bidder will complete registration information in person or online and agree to the terms and conditions of the sale before placing a bid. Any questions, ask before bidding please. * All bids are subject to (i) a non-refundable 20% buyer's premium /5% discount for cash payments/ which shall be added to a successfully placed bid upon sale of each lot, (ii) any applicable local sales tax, and (iii) shipping and handling costs that are more fully described in the section entitled "Shipping and Handling" (collectively, the "Purchase Price"). For all residents of Illinois or shipments to Illinois, applicable sales tax will be added to your invoice. Any bidder that represents a purchaser is personally and individually responsible for any obligations of the purchaser set forth in these terms and conditions. All purchasers purchasing pursuant to a valid resale license will need to provide appropriate documentation for removal of state sales tax. * LIQUIDATED DAMAGES: IN THE EVENT THAT YOU BID AND ARE DEEMED THE WINNER OF AN ITEM BY TRISTAR CITY LLC, BUT FAIL TO MAKE PAYMENT IN ACCORDANCE WITH THE INVOICE SENT TO YOU OR CLAIM A DISPUTE WITH ANY THIRD-PARTY PAYMENT INTERMEDIARY, SUCH AS A CREDIT CARD COMPANY, YOU WILL BE ASSESSED A CHARGE OF 15% OF THE HAMMER PRICE AS LIQUIDATED DAMAGES. BY BIDDING ON ANY SUCH LOT YOU HEREBY AGREE TO THE PAYMENT OF SUCH LIQUIDATED DAMAGES AS A RESULT OF THE IRREPARABLE HARM THAT WILL BE SUSTAINED BY TRISTAR CITY LLC. FURTHERMORE, IN THE EVENT THAT A WINNING BIDDER FAILS TO MAKE ANY PAYMENTS UNDER THESE TERMS AND CONDITIONS, INCLUDING THE LIQUIDATED DAMAGES DESCRIBED HEREIN, WE RESERVE THE RIGHT TO REPORT SUCH NONPAYMENT TO CREDIT AND COLLECTION AGENCIES IN OUR SOLE DISCRETION. * Applicable taxes. Illinois State Sales Tax will be charged at 10.25% to any buyer who does not hold a valid IL Tax Exemption Number that is on file with us here at TRISTAR CITY Auctions. PAYMENT: * By agreeing to our terms and conditions, you agree to allow us to charge the credit card on file if you are the winner upon close of the auction. * Any purchases exceeding $1,000 or purchases where we are unable to verify the buyer's identity and shipping address may require wire transfer as payment, unless you are personally known by the owner/manager or have valid ID registered with us. Payment in full is expected and required before we will release the item to the buyer. We require a photo ID to approve you to bid if you are unknown to us. All purchases from Canada above $500 require a Bank Transfer, unless you are a regular bidder with us. Then the amount will be above $2,000. If you are buying GOLD or SILVER, also all purchases above $1,000 payment needs to be by Bank Cashier's Check ONLY or bank Transfer /$20 additional fee required for each bank transfer/. * Buyer's Premium of 20% will be added to all successfully bidded lots. No Exceptions!! A 5% DISCOUNT will be applied for those paying by check or cash. Please note that the credit card that you place on file is the credit card that will be billed, and the address you provide is the shipping address where your items will be shipped to. The auction software uses a credit card verification system that validates credit cards and matching addresses, so ship to addresses cannot be changed. In some instances, for cash payments, especially for orders over $1000, a deposit amount of 17% will be charged on a card on file and will be refunded immediately once we receive the cash payment. The Illinois residents subject to 10.25% sales tax. All auctions in the United States are considered to with reserve unless they are advertised as absolute, this auction is not absolute, and all pieces are sold with reserve unless specified otherwise on the listing itself. The auction company reserves the right to bid on behalf of the reserve price. Tristar City LLC uses a third-party software for online auctions. The auction company nor the software provider will be responsible for any interruption in service, errors, caused by any means including power failures or website outages. This auction is conducted electronically and relies on hardware and software that may malfunction without warning. The Auctioneer, in its sole discretion, may void a sale, suspend bidding and re-sell any item/lots that were affected by any malfunction. The decision of the Auctioneer is final as is the case in a live auction. NOTICE: Some purchases are not eligible for credit card payment and will require bank wire transfer. Wire transfer is due within 48 hours of the conclusion of the auction. The auction company, at their discretion reserves the right to cancel any purchase that is not paid in full within 48 hours. * INVOICE PAYMENT REQUIREMENTS & TYPES ACCEPTED: Cash, Check, and Credit or Debit Cards due at close of auction or immediately upon invoice. Back charges or bad checks will be charged to the buyer and may result in being a banned bidder. Pesonal checks ae not accepted. Cashier's check, Money order or eCheck only. SHIPPING: * Buyers are to pay all shipping charges. Shipping will be added to the total cost of the item(s) (hammer price + buyer's premium + sales tax (if applicable). There will be a minimum $5 handling fee for all shipping invoices. Packaging charges depends on the size of the item/s, starting from $5 for small items. We offer in house shipping for bigger items as well. We will send you a quote after the end of the auction if you choose to use our services. You are free to use a third party shipper of your choice. * Large, extremely fragile, freight shipping Purchases from auctions marked SHIPPING ONLY are not elligible for pick up. Buyer has three (3) business days to contact the office (224-391-6656) with shipping arrangements. All exceptionally large, fragile, or irregularly shaped items will be packaged through UPS Packing and shipped via UPS. Furniture, large signs, or extra large pieces may require freight (anything over 110lbs packaged). Uship.com is a reliable shipping option for large pieces (i.e. furniture), we also offer in house freight shipping. * We offer in-house shipping for coins, jewelry, and rugs ( weighing under 70lbs). All other items will be taken to the UPS Store for shipping. These items will be sent via USPS * Non-Payment for Shipping If the buyer refuses or does not wish to pay for shipping, TRISTAR CITY Auction will not, for any reason, refund the Buyer and the Buyer forfeith any right for a refund. All items must be arranged for shipping within 7 days after the auction closes. After that $10 daily fee will be accumulated. All items not shipped out from our warehouse within 14 days due to non payment of shipping fees, will be sold for storage fee and you will forfeit your items. * International buyers are responsible for any and all customs fees in addition to shipping charges. Please NOTE: All orders above $150 will require Signature confirmation for the cost of $10 CREDIT CARD CHARGEBACKS PROHIBITED. The "Limited Returns" provision set forth herein below provides the limited availability and procedure for facilitating Product returns in specific situations. Absent the express eligibility and strict adherence to the procedures for facilitating a return, Bidders shall not be entitled to return Product(s), partial or full refunds, wire recalls, stop payments on checks or credit/debit cards, or the initiation of a chargeback claim with a Bidder's credit/debit card provider. BIDDER UNDERSTANDS, ACKNOWLEDGES AND AGREES THAT THERE EXIST NO LEGAL BASIS FOR INITIATING A CHARGEBACK CLAIM FOR ANY PURCHASED PRODUCT, AND BIDDER SPECIFICALLY AGREES TO REFRAIN FROM THE FILING OF ANY SUCH CLAIM. In the event a Bidder does not receive a purchased Product within thirty (30) days of payment, or the Bidder takes issue with a Product's grading or condition, Bidder's only recourse shall be against the third-party shipping company's insurance and/or the appropriate grading service. LIMITATIONS OF LIABILITY Tristar City LLC acts in many cases as the agent for the consignor and in no event will be liable for any breach or default by the consignor. In consideration of participation in Tristar City LLC Auctions or "Buy it Now " listings, you, for yourself, your heirs, agents, successors, and assigns, generally and specifically waive and release, and forever discharge Tristar City LLC and its owners, members, managers, officers, employees, agents, attorneys, and representatives, and their respective successors and assigns, from any and all claims, rights, demands, causes of action, arbitrations, lawsuits, or other legal proceedings, of whatever kind or nature, including, but not limited to claims base dup on Tristar City LLC 's alleged negligence, whether in law or equity, tort or otherwise, whether known or unknown, suspected or unsuspected, which you may assert with respect and/or arising out of, or in connection with any challenge to the title to or authenticity of any Product purchased, the sale itself, any Product/lot bid upon or consigned, the Auction, or the "Buy it Now " listing, except where such Claim expressly authorized in this Agreement . It is your intention that is waiver and release shall be effective as a bar to each and every Claim that may arise here under or be related to the services, Auction, "Buy it Now" listing, the Sites, and/or the Product (s), and you hereby knowingly and voluntarily waive any and all purported rights and benefits otherwise conferred upon you by statute or common law. EXPORTS AND PERMITS It is your sole responsibility to identify and obtain any necessary export, import, firearm, endangered species or other permit for the lot. Any symbols or notices in the sale catalogue reflect our reasonable opinion at the time of cataloguing and are for bidders general guidance only. We make no representations or warranties as to whether any lot is or is not subject to export or import restrictions or any embargoes. ARBITRATION In the event any dispute arises between Tristar City LLC and you concerning respective rights or duties hereunder, each party agrees to notify the other party immediately and to first attempt to resolve the matter by negotiation. If no mutually agreeable resolution is had after fourteen days (14), a party may demand arbitration. Any arbitration shall be under the Commercial Rules of the American Arbitration Association (AAA) and held in Chicago, Illinois. One arbitrator shall conduct the arbitration and decide the matter. Judgment on any award shall be binding and may be entered and enforced in any court of competent jurisdiction. AGREEMENT REGARDING GOVERNING LAW, VENUE, AND LEGAL RIGHTS I hereby understand and agree that any controversy or claim arising out of or relating to Tristar City LLC Bidder Terms & Conditions of sale, which includes this provision (hereafter referred to as Terms & Conditions), Tristar City LLC, or the breach thereof (hereafter referred to as Claims), shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law provisions. I hereby irrevocably submit to the personal jurisdiction of the appropriate court in Cook County, Illinois in any action or proceeding arising out of or relating to the Claims and their enforcement, and I agree that any and all Claims must be adjudicated, heard, determined, and resolved in said court, and I hereby irrevocably waive any objection on the ground that any such action or proceeding in said court has been brought in an inconvenient forum. Tristar City LLC failure to exercise or enforce any right or provision of these Terms & Conditions or any other legal rights, shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms & Conditions by Tristar City LLC must be made in writing and signed by an authorized representative of Tristar City LLC specifically referencing the provision(s) contained within the Terms & Conditions to be waived. Headings used in the Terms & Conditions are for convenience only and are not to be relied upon. If any provision of the Terms & Conditions is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the Terms & Conditions shall remain in full force and effect. These Terms & Conditions will inure to the benefit of, and are intended to be, enforceable by Tristar City LLC, its parents, subsidiaries, affiliates, successors, assigns, members, directors, officers, and licensees. There are no third party beneficiaries to these Terms & Conditions; a person or entity who is not a party or signatory to these Terms & Conditions has no rights under the Contracts (Rights of Third Parties) Act 1999 to rely upon or enforce any term or provision of these Terms & Conditions. * A Local Court will be used for resolution of disputes. * Absentee Bids are treated as if you are sitting here at any of our live auctions and need to be placed up until the day before the closing of the sale. Bids are Executed Competitively. * For internet-only auctions We Reserve The Right to Cancel And/Or Reopen the auction in case of any system failure. These terms and conditions, the contents of any listing and the contractual relationship between TRISTAR CITY LLC and any bidder shall be interpreted under and governed by the laws of the State of Illinois. **IMPORTANT - PLEASE READ** AS YOU HAVE ACKNOWLEDGED BY AGREEING TO THE TERMS AND CONDITIONS OF THIS AUCTION, THERE ARE NO REFUNDS OR EXCHANGES. ACCORDINGLY, THE RESTOCKING FEE, BUYER'S PREMIUM, AND ANY SHIPPING AND HANDLING COSTS ARE NEVER ELIGIBLE FOR A RETURN OR REFUND.
