TERMS: Auction terms and conditions - please review all Online terms prior to bidding! All auction lots are sold AS-IS, where-is without any warranties whatsoever. A 13% Buyers Premium will be added to the final bid price to determine final selling price. All purchases made by Indiana Residents will be subject to 7% Indiana Sales Tax. Sales tax will be charged on the Hammer Price and Buyers Premium. Any winning bid over $5,000.00 must be paid in cash at pickup or with a wire transfer at the expense of the buyer. A 3% discount will be given to any cash or check buyers - you must notify us before end of auction if paying by cash or check. Items must be picked up on location above. Pickup will be Friday, November 22 from 10:00am-4:30pm EST (9:00am-3:30pm CST) at location. PLEASE NOTE: PICK-UP IS TO BE SCHEDULED BY APPOINTMENT ONLY through our online signup genius calendar via email link. You will receive a link with your paid invoice to sign up for a specific pick-up time. Auction crew may only allow 3 people in the building at one time to remove large items. Buyers with one small item or several small items may be asked to wait for auction crew to bring their items out to them. Buyers must bring help to load any purchases of furniture, appliances or large Items. Dixon's will not supply help to load these items, especially items in basement. All items sold online on location must be picked up on scheduled pickup dates/times. If items are not picked up on these set dates/times, buyer must notify Dixon & Dixon Auction Service LLC before the end of auction and other arrangements must be made ASAP. Any specialized arrangement for pickup outside of the scheduled dates will be subject to an additional handling fee. All items must be picked up by no later than last day of pickup or they will be considered abandoned. Items left after that time will be forfeited back to Dixon & Dixon Auction Service LLC. All Sales Final, NO REFUNDS will be issued. BIDDERS ARE SOLELY RESPONSIBLE FOR packing, loading and moving all items purchased without assistance from Dixon & Dixon Auction Service LLC. Dixon & Dixon Auction Service LLC will not supply any tools, boxes or packing materials. The winning bidder on large items needs to bring help and the equipment needed to load the item(s). Statements day of sale take precedence over all printed materials. WAIVER - Buyer acknowledges that while on the premises of auction certain risks and injuries, sickness, death, property damage or other harm could occur to himself or others. Buyer accepts and voluntarily incurs all risks of injuries, damages, or harm which may arise during or resulting from any participation of such activities, before, during or after the auction. Buyer fully assumes the risk of illness or death related to COVID-19 arising from my being on the premises and participating in the activities and hereby RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE (on behalf of self and any minor children from whom buyer has the capacity contract) Scotties' Auction Service, LLC dba Dixon & Dixon Auction Service, their owners, officers, agents, employees and assigns (the "RELEASEES") from any liability related to COVID-19 which might occur as a result of being on the premises and participating in the activities. Buyer waives all claims against Dixon & Dixon Auction Service, LLC, and /or its owners, employees, agents or insurers also today's sellers and/or its owners, their employees, agents or insurers ("Released Parties"). Buyer agrees to indemnify and hold the Released Parties harmless from any losses, liabilities, damages, cost or expenses (including but not limited to reasonable attorneys' fees and other litigation cost or expense) incurred by any of the Released Parties as a result of any claims or suits that I (or anyone claiming by, under or through me) may bring against any of the Released Parties to recover any losses, liabilities, costs, damages, or expenses which arise during or result from my removal of items from property of today's sellers, regardless of whether or not caused in whole or part by the negligence or other fault of any of the Released Parties. Buyer acknowledges that by attending open house or pickup at said auction on an inclement weather day, there will be risks involved such as rain, ice, snow, hail, extreme heat, etc. that may affect myself or someone in my party. The Buyer takes full responsibility for himself and all in his party when attending the auction under such conditions. Dixon & Dixon Auction Service LLC assumes no responsibility for any missing or incorrect listing information. All information is gathered from sources believed to be reliable but is not guaranteed to be accurate. Item descriptions and listing are subject to be changed, updated or canceled at any time without notice. All bidders agree that his or her own decision to bid and the amount he or she bids have been based solely on his or her own independent inspection and evaluation of the items. ALL SALES ARE FINAL - NO RETURN/REFUNDS!! This auction features a ONE (1) minute soft close with a THIRTY (30) second stagger time for each lot. In the event there are technical difficulties related to the server, software or any other Online auction-related technologies, Dixon's Auction Service LLC reserves the right to extend bidding, continue the bidding, or close the bidding. Neither the company providing the software nor Dixon & Dixon Auction Service LLC shall be held responsible for a missed bid or the failure to the software to function properly for any reason. Dixon & Dixon Auction Service LLC reserves the right to cancel this auction, or remove any item/lot from this auction prior to the close of bidding. The identity of all bidders will be verified. Dixon & Dixon Auction Service reserves the right to reject the bidder's registration if there is any question as to the person's credentials. Dixon & Dixon Auction Service LLC reserves the right to reject, deny or permanently ban bidding priveleges on this auction or future auctions at our sole discretion. Dixon & Dixon Auction Service LLC reserves the right to reject any and all bids for any reason. Final accepted bid is a legal binding contract. Bidder assumes all risk of loss or damage to the item at the end of the auction. Dixon & Dixon Auction Service LLC reserves the right to resell any personal property that is not paid for in full and picked up by the stated pickup date/dates. In any such event, the bidder will still be responsible for payment for the original purchase and the costs of collection of this payment and/or damages resulting for the resale of the property. Dixon & Dixon Auction Service LLC reserves the right to bid on behalf of the Seller and the Buyer. Buyer and or Bidder agrees to hold harmless and indemnify Dixon & Dixon Auction Service LLC and its agents, owners, employees and its representatives from any and all claims, damages or suits including but not limited to awards, judgments, costs, fees, etc. By bidding on any item, buyer agrees to all terms and conditions set forth. Payment: All purchases will be automatically charged the following morning after the auction has closed with your credit card on file with HiBid. Payment must be made before item(s) are removed. ALL SALES ARE FINAL. NO RETURNS OR ADJUSTMENTS WILL BE MADE. PICKUP: Items are to be picked up on the arranged pickups day(s). If you are not able to do so, you must notify Dixon & Dixon Auction Service LLC immediately and other arrangements must be made ASAP. Any specialized arrangement for pickup outside of the scheduled dates will be subject to an additional fee. All items must be picked up within 3 days of the auction's end date if Auction is located at Dixon's facility. Items left after that time will be forfeited back to Dixon & Dixon Auction Service LLC.
