Williams Auction Service Terms & Conditions TERMS AND CONDITIONS FOR THIS AUCTION: (Please note that terms and conditions may be different for each auction and they are subject to change.) 1. All items sold "AS IS, WHERE IS" with all faults. HOLD HARMLESS: Buyer and or bidder agrees that Williams Auction Service is a representative of the Seller and agrees to hold harmless and indemnify Williams Auction Service and its Agents, Owner, Directors, Employees and its Representatives from any and all claims, demands, expenses, damages which bidder/buyer may claim on account of or any way growing out of said auction and to look solely to the Seller for any remedy demanded. 2. All descriptions believed accurate but not warranted. 3. By placing a bid, bidder signifies that they have examined the items to their satisfaction, or that they have chosen not to personally examine them. 4. BUYERS PREMIUM: A 15% buyer's premium will be added to each purchase. 5. SALES TAX: 7.25% sales tax will be added to all purchases. 6. PAYMENT: The following payments will be accepted: Credit Cards, or in person transactions using good check with photo ID or cash. If using a credit card, the credit card on file will be automatically charged IMMEDIATELY after the conclusion of the auction for the entire amount of your purchase(s) (unless otherwise indicated). Be sure to have an available balance on your credit card for your online purchases. We have the right to deactivate any bidder's account or cancel the bids of any bidder. For in person transaction; cash or good check with photo ID accepted. 7. SHIPPING AND HANDELING: Shipping services are available. Our shipping and handling fees are the buyer's responsibility and cost. This charge will be added to the hammer price. This only applies to items that we can easily pack and ship, not large or hazardous items. You must reach out to Williams Auction Service by phone or email to set up shipping. Your card on file will be charged the total shipping and handling fees after setup. 8. PICKUP: To pick up items, you must set up with one of our available dates and times. ALL DATES GIVEN WILL BE WITHIN A WEEK AFTER THE CONCLUSION OF THE AUCTION. Once again, you will need to contact us to set this time up. With current situations, there will be staggered and certain meet up times due to social distancing order. Any item NOT picked up by the set time will be considered abandoned. Removal shall be at the expense, liability, and risk of the purchaser. Purchases will be released upon presentation of ID and paid receipt. Please ensure that movers or anyone picking up items on your behalf have your paid receipt at the pickup location. 9. AUCTION DESCRIPTION: Please inspect the lot numbers and read the descriptions. You are bidding on the described item not the photograph, occasionally the wrong photo may be displayed. The photo may also depict other items that are not included, which will be noted. Always read the item description. NOTE: When you bid on the wrong item or decide an item is not suited for your intended use, our Seller(s) are not willing to assume the cost of your mistakes. When in doubt about condition, completeness or suitability for intended use, bid to your discretion. 10. Registration: In order to better serve our customers, all bidders must provide their name, address, daytime phone number or cell number, and email address at which they can be contacted. Credit card and Driver's License Information is required at registration also. This is to insure good communication between Williams Auction Service and the bidder throughout any transactions. Each bidder's identity will be verified. Bidding rights are provisional, and if complete verification is not possible, Williams Auction Service will reject the registration, and bidding activity will be terminated. Our on-line auctions move quickly! If you are interested in bidding, bid quickly, especially at the close of the bidding time. The bidding software will notify bidders by email at registration when they have been outbid. Bidders may also check if they have been outbid by refreshing the individual lot information or the entire screen.
