TERMS:
10% down as non-refundable earnest money down payment in the form of a certified check, cash, personal check with an up to date bank letter guaranteeing funds addressed to Butler Auctioneers LLC or wire transfer due day of auction for on-site bidders and within 48 hours of the close of auction for online bidders, with the balance of purchase price due by Tuesday, December 31st, 2024.
Possession will be given at closing.
Real Estate Taxes and Closing Cost: Sellers will pay the real estate taxes for the 2024 year. The purchaser will pay all other closing costs associated with the purchaser's side of the sale, including local and state recording fees and any cost associated with the purchaser's loan.
Buyer's Premium: There will be a 10% Buyer's Premium added to the winning bid. The sum of the winning bid plus the Buyer's Premium will be the sale price.
This Auction is not contingent on or subject to financing, appraisal, survey, or inspections of any kind, as agreed to by bidders at registration prior to bidding. If the buyer is obtaining financing please speak with your lender to ensure the loan can be completed by the specified closing date before bidding.
Seller and Buyer(s) shall pay their share of the costs of closing. The buyer acknowledges they are buying property "as-is", "where-is", without inspections or contingencies. The buyer(s) will rely on his/her own judgment and inspection ALL SALES ARE FINAL! The bidder understands and agrees that no refunds, exchanges, adjustments, chargebacks, etc., will be allowed. Property is available for inspection at specified times, and it is the bidder's responsibility to determine the condition. Bidder's failure to inspect any item or lot will not constitute grounds for any claim, refund, adjustment, chargeback, etc.

Online Bidding:
All internet bidders must be registered and be approved by Butler Auctioneers LLC atleast 24 hours prior to the auction in order to bid online.
Max Bids: Using the Max bed feature is recommended to avoid chances of internet issues during the close of the auction. But using the Max bed feature the program will bid for you without you having to log in or watch the close of the auction. The program will only increase your bid when someone else out bids you up to the max bid you have set.
Online registration: Bidder verification is required. All information provided by the bidder/buyer during the registration process must be current, complete, and accurate. Bidders must be 18 years of age or older to bid on items. Butler Auctioneers LLC or Americana Real Estate & Auction at its sole discretion, may deny registration to any person or entity. SERVER & SOFTWARE TECHNICAL ISSUES: In the event there are technical difficulties related to the server, software, or any other online auction-related technologies, Butler Auctioneers, LLC reserves the right to extend bidding, continue the bidding, or close the bidding. NEITHER THE COMPANY PROVIDING THE SOFTWARE nor BUTLER AUCTIONEERS LLC SHALL BE HELD RESPONSIBLE FOR A MISSED BID OR THE FAILURE OF THE SOFTWARE TO FUNCTION PROPERLY FOR ANY REASON.
Email notifications will be sent to registered bidders with updated information as deemed necessary by Butler Auctioneers, LLC.
Any dispute between Butler Auctioneers LLC or Americana Real Estate & Auction, its Agents or Representatives, and the Buyer(s) will be tried in a court of jurisdiction in Breckinridge County, Kentucky. By bidding on the property, the buyer agrees to all terms and conditions set forth.

This live and simulcast auction will be held off-site at the Breckinridge Co. Fairgrounds located at 217 Fairgrounds Rd Hardinsburg, Ky 40143 Tuesday November 12th, 2024, at 5:30 PM CT inside the merchants building.
The farm has approximately 120 acres of crop and open ground with the remaining 494 acres being wooded, offered in 15 tracts ranging from 2 acres up to 176 acres. The timber will sell with the property. There is an abundance of wildlife on the property offering great opportunities for hunting and recreational use. There are 2 barns located on the property. This property is conveniently located approximately 16 miles from Leitchfield KY, 17 miles from Hardinsburg Ky and 30 miles from Elizabethtown Ky.
The real estate can be inspected during daylight hours only at your own risk. Please do not damage the crops in the fields. The current tenant has until December 31st, 2024, to harvest the 2024 crop.
