Buyer Details: 1. Bidder Registration: All potential Buyers must be registered with Hueckman Auction & Sales in order to bid. Existing users can use their current username and password to register. New Bidders will need to register by clicking the “Register to Bid” button within the auction and create a new bidding account. All Bidders must be at least 18 years of age. 2. Bidder Identity: The identity of Bidders is subject to verification by the Auction Company. The Auction Company reserves the right to preclude anyone from bidding, or reject registration and terminate bidding activity if there is any question as to the Bidder’s credentials. 3. Buyer’s Fees: There will be a 5% Buyer’s Fee added to the winning high bid to determine the final purchase price. 4. Seller's Acceptance: This is an absolute auction and will sell to the highest Bidder. 5. Payments: Upon a successfully accepted high bid, Buyer agrees to submit Earnest Money in the amount of $3,000 to the Auction Company. Payment must be received within 5 days of acceptance and in the form of cash, certified check, or personal/company check accompanied by a bank letter of guarantee. Balance of the purchase price shall be paid at or before closing. In the event that the Buyer does not close on the property, their Earnest Money shall not be refunded. In the event that the Seller does not close on the property, Earnest Money will be refunded to the Buyer. Contingencies & Inspections: 6. Contingencies: This auction is a cash sale not contingent on or subject to financing, appraisal, survey or inspections of any kind, as agreed to by Bidders at registration prior to bidding. 7. Absence of Warranties: Property information for this auction has been provided by the Seller and/or other third parties. All information provided is deemed reliable but not warranted by Seller or Auction Company. Buyer shall perform any independent inspections with respect to the property as they deem necessary and/or appropriate. All inspections shall be completed before bidding. The Buyer agrees: The Seller and Auction Company offer NO warranties or representations pertaining to condition or fitness of the property, environmental or otherwise, or any improvements thereon. Deed: Seller shall provide a warranty deed to Buyer at closing. 12. Occupancy: Buyer shall take occupancy of property at the time of closing. NO EXCEPTIONS. 13. Real Estate Taxes: All taxes shall be prorated to the day before closing using the previous year’s tax amount. 14. Easements: Subject to any and all easement of record. 15.
