These Terms and Conditions govern your use of our auction services, including bidding on and purchasing items through our auction. By using our auction services, you agree to be bound by these Terms and Conditions. TERMS OF SALE: All purchases are subject to the terms and conditions set forth in the Buyer�s Contract. Statements made by Luther Bros Auction Co. (LBAC) on day of auction and represented as a term and condition of the sale become part of the Buyer�s Contract. All Purchases must be paid in full the day of the sale unless the buyer is wiring funds directly to LBAC in which case funds must be received by 5 days after the completion of sale, and prior to the removal of items from premises. If a dispute arises between two or more bidders, or for any other reason, the auctioneer will decide the dispute or resell the item. All items are sold �as is, where is.� The auctioneer assumes no liability for any guarantee made by the seller, the condition of the item, or transport cost for any item. All items are purchased with all faults and with no guarantees or warranties of any kinds. The auctioneer is not liable for any direct, indirect, or consequential injury, damage, or loss incurred in connection with the sale or purchased item. If the auctioneer is unable to deliver any purchase or deliver such purchases free and clear of lien, auctioneer may terminate the purchase agreement with only the obligation to return the purchase money. Purchaser assumes responsibility for items when �sold� or upon delivery to purchaser. Auctioneer makes no representations concerning and assumes no responsibility for the validity or the timing of proving title to equipment or vehicles. Other Terms & Conditions: All customers who want to place a bid must sign Buyers Agreement. Buyers Premium Notice- A 10% Fee will be charged on every item purchased. All items must be removed from premises within 30 days or items will be sold to cover handling and storage fees. Internet buyers will be charged a 2% fee on total purchase. An additional 4% Administration Fee will be assessed. You MUST have proof of receipt before exiting the auction site. All title items will be invoiced a $35 Title Fee. We reserve the right to modify these Terms and Conditions at any time, without notice. Your continued use of our auction services after any modification constitutes your acceptance of the modified Terms and Conditions. Governing Law These Terms and Conditions shall be governed by and construed in accordance with the laws of North Carolina. Any legal action arising out of or in connection with these Terms and Conditions or our auction services shall be brought in the courts of New Hanover County (NC).
