Absentee bids (bids not made online) will be accepted in writing and with valid credit card number, which will be verified by you for maximum bid amount and applicable Buyer's Premium prior to the sale. This amount will be entered into the online auction by Hartland Auction & Realty LLC for you but you must realize that you might still be outbid by online bidders. All absentee bids will be held in confidence. You understand and agree that any violation of these Terms and Conditions - and/or any unsafe or illegal activity during any auction-related event - may result in Hartland Auction & Realty LLC suspending your online bidding privileges indefinitely. Any Bidder's attempt to re-register after having been suspended - whether directly by creating a new account or indirectly by using or directing the use of a third party's account - will constitute a breach of these Terms and Conditions, and may expose the Bidder to civil and criminal liability for fraud. Nothing in this paragraph will limit the Auctioneer's right to any other remedies at law or in equity. DEBT COLLECTION and INTEREST CHARGES The bidder agrees to pay all reasonable attorney fees and other costs incurred by Hartland Auction & Realty LLC, in its efforts to collect unpaid funds from the bidder. The bidder agrees that a fee of 2% of the outstanding balance per month be added to any unpaid balance due Hartland Auction & Realty LLC. Any debt collection or dispute proceedings will be heard in Effingham County, Illinois. Hartland Auction & Realty LLC online auctions are structured to replicate a live auction. As a result, this auction incorporates a staggered, dynamic closing system. **Staggered Closing:** To maintain an orderly pace, this online auction will typically initiate the closing process for a new item every 15 seconds. The website will display the scheduled closing times for each item. However, it's important to note that the closing time may be extended beyond the original schedule due to the dynamic closing feature. **Dynamic Closing:** Whenever a bid is placed within the final two minutes leading up to an item's scheduled closing time, the closing time for that item is automatically extended by an additional two minutes. This dynamic closing mechanism ensures that participants have a fair opportunity to submit competing bids and cannot get outbid within the last second. SERVER & SOFTWARE TECHNICAL ISSUES: In the event there are technical difficulties related to the server, software or any other online auction-related technologies, Hartland Auction & Realty LLC reserves the right to extend bidding, continue the bidding, or close the bidding. Neither the company providing the software nor Hartland Auction & Realty LLC shall be held responsible for a missed bid or the failure of the software to function properly for any reason. Email notifications will be sent to registered bidders with updated information as deemed necessary by Hartland Auction & Realty LLC. To participate and bid in this auction, you, the bidder, must read and accept all of the terms and conditions of this auction completely. Once you place a bid, you are electronically signing and consenting that you have read and accepted all of the terms and conditions set forth in this agreement completely and without exception. By placing any bid on any item(s), you are entering into a legally binding and irrevocable contract with Hartland Auction & Realty LLC to purchase the particular item(s) in accordance with the terms and conditions of the auction.
