• All equipment is sold in its current “as is, where is, with all faults” condition. • No Express Warranty or Implied Warranty of Merchantability or Fitness for a Particular Purpose, Use or Application is given by Seller to Buyer for any item of equipment. • No Guarantees including, but not limited to, that of equipment condition are given Buyer by Seller. • Buyer must make payment within 48 hours after receiving its invoice and send Seller a Certificate of Insurance (see requirement in Removal Terms). • Buyer must arrange logistics within 10 days after payment has been made. • Seller will sign and acknowledge equipment being released to Buyer. • If equipment is not picked up within the timeframe set by Seller, Buyer will forfeit the equipment and money paid. • Legal title and risk of loss passes from Seller to Buyer at the location of equipment pickup and prior to its movement from its then current location. This applies whether Buyer picks up the equipment itself or arranges for a designated third party to pickup and deliver the equipment to Buyer.
