CONDITIONS OF SALE The conditions of sale of real estate, the property of the ESTATE OF HAROLD W. NOECKER and the HAROLD W. NOECKER and SONDRA J. NOECEKER REVOCABLE LIVING TRUST to be held on May 26, 2022 on the hereinafter described premises situate at 385 Hanover Street, Borough of Northumberland, County of Northumberland and Commonwealth of Pennsylvania, are as follows: 1. The real estate to be sold consists of: ALL that certain lot or parcel of land situate in the Borough of Northumberland, Northumberland County, Pennsylvania, being more particularly bounded and described as follows: BEGINNING at the intersection of the southwesterly line of Hanover Street and the southeasterly line of Fourth Street: thence in a southeasterly direction along Hanover Street, a distance of one hundred sixty (160) feet to a point; thence in a southwesterly direction in a line parallel to Fourth Street, a distance of one hundred eighty (180) feet to a point; thence in a northwesterly direction in a line parallel to Hanover Street, a distance of forty (40) feet to a point; thence in a northeasterly direction in a line parallel to Fourth Street, a distance of sixty-five (65) Feet to a point; thence in a northwesterly direction in a line parallel to Hanover Street, a distance of one hundred twenty (120) feet to Fourth Street; thence in a northeasterly direction along Fourth Street, a distance of one hundred fifteen (115) feet to the point or place of BEGINNING, whereon is erected a single dwelling house. BEING THE SAME PREMISES which Harold E. Diehl, a single person, by Deed dated December 10, 1994 and recorded in Northumberland County Deed Book 986, page 339, conveyed unto Harold W. Noecker and Sondra J. Noecker, his wife. Sondra J. Noecker died November 30, 2011 AND ALSO BEING THE SAME PREMISES which Harold W. Noecker and Sondra J. Noecker, his wife, by Quit Claim Deed dated October 14, 2002 and recorded in Northumberland County Record Book 1482 at Page 780 conveyed unto Harold W. Noecker and Sondra J. Noecker, Trustees of the Harold W. Noecker and Sondra J. Noecker Revocable Living Trust dated October 14, 2002. 2. The highest approved bidder or bidders may be declared by the auctioneer to be the PURCHASER or PURCHASERS, but the SELLER reserves the right to reject any and all bids. 3. The Seller reserves the right to adjourn this sale to a date not more than ten (10) days distant, and during that time to hold all bids. 4. The property shall be sold “AS IS”, and without any warranty or guarantee except that the Deed will contain the usual covenants of special warranty. 5. The property to be sold is offered for sale free and discharged of any lien or liens entered, or liens by process of law, with the real estate taxes to be apportioned on a fiscal year basis between the SELLER and the PURCHASER or PURCHASERS as of the date of settlement. 6. The PURCHASER or PURCHASERS of the real estate offered for sale must assure himself or themselves as to easements, encroachments, or any matters affecting the title or enjoyment of the property and, as bidders and purchasers, must assume and undertake to comply therewith or conform thereto. 7. In the event of any dispute regarding the bids, the property offered shall, at the discretion of the SELLER, be immediately offered for resale. 8. The person or persons to whom the property described herein is struck down must immediately, upon its being struck down, deposit with the SELLER cash or a certified check or checks acceptable to the SELLER, for ten (10%) per cent of the purchase price. The SELLER reserves the right to be the sole judge of accepting or rejecting the checks offered. The person or persons to whom the real estate is struck down must also sign an agreement in the form hereto attached and made a part of these conditions for the faithful compliance in all respects with the conditions of sale and for the payment of the balance in cash within fortyfive (45) days from the date of sale or within such time as the SELLER may allow. Upon execution of said conditions, the same shall be deemed a legally binding Agreement of Sale. 9. The said real estate, after being struck down and until the delivery of the deed therefor, will be held by the SELLER as the property of the SELLER, and the SELLER reserves the right to use and enjoy the said property and the rents, issues and profits therefrom during that period, and at the SELLER’S risk of loss by fire or otherwise. 10. A fiducary warranty deed for the real estate and the building erected thereon will be executed and tendered to the PURCHASER or PURCHASERS within forty-five (45) days or within such time as the parties may agree from the date when the property is finally struck down and will be delivered upon the payment of the balance of the purchase price. 11. Possession of the real estate offered for sale will be delivered at the date of settlement. 12. Realty transfer taxes are to be equally divided between the SELLER and the PURCHASER or PURCHASERS. 13. In the event of the default of the PURCHASER or PURCHASERS of said real estate in respect to any of the terms of these conditions, the deposit in the amount of ten (10%) per cent of the purchase money previously set forth shall be forfeited to the SELLER as damages fairly liquidated and ascertained for the breach hereof, and the SELLER shall have the right to offer said real estate again for sale without any liability to the PURCHASER or PURCHASERS for any surplus received. In the event the SELLER cannot deliver a good and marketable title to the subject premises, free and clear of all encumbrances, within forty-five (45) days or any such other time agreed upon from the date the property is finally struck down, the deposit money of ten (10%) per cent shall be returned to the PURCHASER or PURCHASERS whereupon these Conditions of Sale and Agreement shall become null and void. 14. SELLER represents that she has no knowledge concerning the presence of lead based paint and/or lead based paint hazards on or about the property, and that they have no reports or records pertaining to lead based paint and/or lead based hazards in or about the property. SELLERS however are only fiduciaries who have never resided in the property and who have limited knowledge of the same. PURCHASER or PURCHASERS acknowledge reading the following Lead Warning Statement prior to the signing of this Agreement: “Every Purchaser of any interest in residential real property on which a dwelling was built prior to 1978 is notified that such property may present exposure to lead from lead based paint that may place young children at risk of developing lead poisoning. Lead poisoning in young children may produce permanent neurological damage, including learning disabilities, reduced intelligent quotient, behavioral problems and impaired memory. Lead poisoning also poses a particular risk to pregnant women. The sellers of any interest in residential property are required to provide purchasers with any information on lead based paint hazards and risk assessments or inspections in the sellers’ possession and notify the purchasers of any known lead based paint hazard. The risk assessment or inspection for possible lead based paint hazards is recommend prior to purchase.” PURCHASER or PURCHASERS waive their right to conduct a risk assessment or inspection for the presence of lead based paint and/or lead based paint hazards; and, PURCHASERS acknowledge receiving the EPA pamphlet “Protect Your Family from Lead in your Home” No. 747-K-94-001 prior to the signing of this Agreement. 15.
