Auction Terms & Conditions
IMPORTANT NOTICE: Before registering please read the following information carefully as registering for this auction acts as a legal binding contract between you and Happy Trails Auctions LLC. All disputes will be settled by arbitration in Marathon County of Wisconsin.
TERMS: This is an online only auction. There will be a 10% buyer's premium assessed on this auction. Payment and settlement will be done using your credit card on file and your items will be shipped. All buyers that are a resident of Wisconsin will be charged 5.5% sales tax on all items purchased and buyer's premium unless a tax exempt form is given to us upon checkout. Please read through all the terms and conditions of this auction.
PICKUP DATES: See checkout dates and times. Items are to be picked up from the onsite auctions location, unless your items are being shipped.
PAYMENT OPTIONS: Cash, check, wire transfer, or credit card (Visa, MasterCard, Discover, and American Express). A 4% Credit Card Processing Fee will be added if payment is made by credit card. PAYMENT MUST BE MADE IN FULL DAY OF PICKUP. ALL CHECKS FOR OVER $200 MUST BE CERTIFIED FUNDS. There is a $10 fee for wire transfers under $1,000. ANY ITEMS NOT PICKED UP ON THE DAY OF PICKUP WILL BE CHARGED TO THE CARD THAT IS ON FILE. NO EXCEPTIONS.
CREDIT CARD CHARGES: For no reason what so ever will you initiate a chargeback or reversal on your credit card at any point in time once your card has been charged for the items you won on the auction.
CREDIT CARDS BEING DECLINED: Successful bidders with credit cards that are declined on the day of payment will be charged a $35 processing fee to process an additional credit card. Happy Trails Auctions LLC allows no exceptions to this policy.
NSF CHECKS: Successful bidders with checks that come back NSF will be charged a $50 returned check fee that will be charged to there credit card or the next time they pick up and will loose the ability to pay with a check on future auctions until Happy Trails Auctions LLC decides otherwise. Happy Trails Auctions LLC allows no exceptions to this policy.
COINS & GOLD: All successful bidders that buy gold or $500 or more in coins and are requesting shipping you must pay for your invoice using a certified funds. We will then use the card on file for the shipping and handling.
SHIPPING INSTRUCTIONS: Please contact us before the auction ends to confirm shipping on the items you are interested in. Any items that are to be shipped by the auction company will be shipped in the least amount of boxes as possible and charged $15 handling fee per package unless your item is considered fragile (mirrors, pictures, glassware, etc.) then a minimum $25 handling fee will be charged per package. The buyer will be charged for insurance on the value of the property being shipped according to high bid amount above $50 in value. There will be a 2% or a minimum of a $20 deductible for the insurance of your items. All packages valued at $200+ will also be shipped with a signature confirmation at the buyers expense. If shipping your items the card that you have on file will be used to pay for your items. If you would like to use a different card for payment please contact us by replying to the email containing your invoice to inform us of this. If you are having more than 3 lots shipped you will be charged $1 per lot extra to assist with transfer costs for non fragile items and $4 per lot extra for fragile items to our main location where your items will be shipped from. All items being shipped that the auction company chooses to ship using UPS with be charged a $10 handling fee for the first 3 lots and aditional $1 for each lot after that. The UPS Store in Wausau, WI will contact you to receive payment for packaging and shipping of your items. If you fail to pay for the shipping and packagaing for any reason your items will be forefited to Happy Trails Auctions LLC and not refunds will be given. Happy Trails Auctions LLC is not responsilble for any items that are lost or broken in the mail or broken in transfer to the UPS Store for shipping.
NON-SHIPPABLE ITEMS: If you bid on and win items that USPS does not allow to be shipped through the US mail and you do not pick them up you will be charged for the full amount of the item(s), the buyers premium, and any taxes that the items may be subject to. Those items on their list will not be shipped but any remaining items will be. Those items on the non-shippable list will be forfited to Happy Trails Auctions LLC. NO REFUNDS WILL BE GIVEN AND NO EXCEPTIONS WILL BE MADE.
SHIPPING AMMUNITION: All ammunition will be shipped with UPS so please note that shipping fees may be slightly higher.
AMMUNITION: You must follow the law put in place by the state you live in. If you bid on and win a ammo and your state does not allow it to be shipped to you then you will be charged for the item and they will become property of Happy Trails Auctions LLC. No Exception to this rule will be given.
FAILURE TO PICK UP ITEMS: Due to the size of this auction all items must be picked up at the auction location on the scheduled pick up dates or shipped. No items will be transferred back to our main location. Items not being picked up will be charged $10 per lot on top of the winning bid amount and will be considered abandoned and become property of Happy Trails Auctions LLC and no refunds will be given.
CLEAN-UP STIPULATION: All lots are subject to a clean-up fee if items from your lot(s) are left behind. If items are left you will be charged $40 per hr with a minimum 15 min charge. Also you will be responsible for all fees orrured in disposing of your remaining items with a minimum fee of $10.
ITEMS SOLD: Please note these assets are sold only one time with non-retractable bids. When you bid on any item, you are entering into a binding contract. If your bid is the winning bid on any item, your credit card will be charged for your purchase at the end of the pickup day unless prior arrangements have been made. All property is sold "AS IS, WHERE IS", and ALL SALES ARE FINAL. All Items are considered used condition.
INSPECTION NOTICE: Property is open to public inspection at the dates and times found under Preview Dates and times. It is the Bidder's responsibility to determine age, type of condition, quality, authenticity, realness, uniqueness, genuine aspect, value or any other physical characteristics. Happy Trails Auctions LLC may attempt to describe at best the merchandise in public advertising, on the internet and on the auction site but makes no representations at all. In no event shall Happy Trails Auctions LLC, be held responsible for having made or implied any warranty of salability or condition for any particular use or purpose. Bidder shall be the individual judge of item's value.
OFF SITE INSPECTIONS NOTICE: Bidders, who bid 'off site' and are not present at the online auction or preview, understand and acknowledge that they may not be able to inspect an item as well as if they examined it in person. The bidder is responsible for the determination of age, rarity, physical condition, value, genuineness, or any other physical characteristics. Happy Trails Auctions LLC shall attempt to describe in detail each item and any important information regarding that item. Bidders understand and agree they are bidding over the internet and technical issues may occur that Happy Trails Auctions LLC has no control over and is not responsible if your bid fails to be recorded, this is especially important near closing times due to high volume. Happy Trails Auctions LLC strongly suggests you take advantage of our max bid feature so you are covered in the most efficient way possible. Happy Trails Auctions LLC will not be responsible for any omissions, errors, or misprints in the description of any merchandise or auction items. Auction lots can be removed from the auction at any time prior to close of the auction. Bidder agrees that everything is sold "AS IS, WHERE IS", and ALL SALES ARE FINAL and that they may not return any item they purchase for any reason.
OUTBID NOTICES: Please remember to refresh your screen to find out if you have been outbid. To refresh your screen, you need to click on refresh for the whole page to refresh or use the refresh button on your browser. This is most pertinent at the end of the auction.
EXTENDED BIDDING FEATURE: This auction features extended bidding. Any lot that receives a bid within 3 minutes of its scheduled closing time will remain open for bids past its normal close and will then enter into extended bidding. The lot will remain open until there are no bids received on that lot in the last 3 minutes of any extended bidding. This only affects lots with the last 3 minute bids; other lots will continue to close at their normal times. When a max bid is placed, the current bid price does not automatically go to your max bid. Another bidder has to bid to increase the current price and the computer will automatically inject your bid in the next increment, continually after being outbid, until it reaches your maximum bid amount.
TECHNOLOGY ISSUES: Happy Trails Auctions LLC reserves the right to pause, stop, restart or extend any auction due to technological issues that may occur during the course of the duration of the auction. No discounts or refunds will be given if this occurs.
AGE RESTRICTED ITEMS: All items that are sold that require a minimum age to be purchased will be enforced by Happy Trails Auctions LLC upon the sale and pickup of those items. They items include but are not limited to adult material, alcohol, long guns, handguns, etc.
FIREARMS:
- Guns must be paid for at the auction pick-up location prior to doing firearm transfer.
- All transfers will be conducted by E-ways Sales & Pawn Shop LLC, Stevens Point Location.
- $20.00 transfer fee per firearm and an additional $10 fee per handgun.
- No transfers on barrels or uppers.
- Long-gun buyers must be at least 18 years old.
- Handgun buyers must be at least 21 years old.
- All firearm sales are subject to all federal and state firearm regulations.
- All out of state buyer regulations apply.
- Out of state firearm purchases must have firearm shipped to licensed FFL dealer in the state they have residency in, and you must coordinate shipping with E-ways Sales & Pawn Shop LLC, Stevens Point Location after your firearms have been paid for in full.
- All firearms not picked up in person at E-ways Sales & Pawn Shop LLC, Stevens Point Location or shipped to a licensed FFL dealer by November 24th, 2021 become property of Happy Trails Auctions LLC and no refunds will be given.
- All shipping, transfer fees and charges must be paid by the purchaser.
- Shipping of firearms will be handled by E-ways Sales & Pawn Shop LLC, Stevens Point Location, buyers are responsible for all shipping charges.
- Firearms up for bids have not been inspected by a gunsmith.
- All purchasers that are having their firearms shipped will have the card on file charged for payment.
- All firearm transfers subject to federal/state background check.
- Purchasers who fail the federal/state background check abandon any and all firearms to Happy Trails Auctions LLC and no refunds will be given.
- Firearms will not be sold to bidders that do not comply with all requirements.
- Firearms will not be sold outside the USA.
- All sales are final with no refunds or exchanges.
- C & R Licenses will not be excepted.
- NO EXCEPTIONS TO ANY OF THESE STIPULATIONS WILL BE ALLOWED.
RESALE: Happy Trails Auctions LLC reserve the right to resell any property not paid for in full on auction day or not picked up within the 5 day storage period. The Buyer shall be responsible to Happy Trails Auctions LLC for any expenses of resale and collection and damages resulting from the resale.
LOADING: Happy Trails Auctions LLC, anyone working for us, or the owners of the property being sold are not responsible for anything that might get broken or damaged during the of loading of your items even if they are helping load them. All risk of damage to items is assumed by the buyer once the auction has ended. If items are broken the customer is still responsible for paying for them and no refunds or returns will be given for any reason.
INJURY & DAMAGE: Bidder acknowledges responsibility for any personal injury or property damage caused by Bidder or his Agent, and further agrees to hold Happy Trails Auctions LLC, Owners, its Officers, or Employees harmless for any personal injury to himself or his Agents and any property damage incurred on auction premises during preview or pickup.
MISC: No refunds will be given. Happy Trails Auctions LLC reserves the right to alter this agreement at any time. This will take place by updating this website. Please check back and review these terms every time you use this site you are agreeing to the terms as they are written at that time. Happy Trails Auctions LLC reserves the right to cancel any auction at any time for any reason. All sales are final. A bid is a legal binding contract between you and Happy Trails Auctions LLC. Happy Trails Auctions LLC reserves the right to reject any and all bids for any reason. Bidders agree to keep their username and password confidential as they are responsible for ANY and ALL activity involving their account. When using this web site you must obey any and all local, state, and federal laws. Violations will result in termination of web site use privileges. Auction company employees and/or the auction company may bid on auction items. We gather aggregate information from this web site which may include but is not limited to: number of page visitors, most visited pages, any and all correspondence. Thank you and good luck bidding!
